    Phone them up and ask for the claim handler (ok they'll be in a meeting, at lunch, shagging the secretary/boss but you gotta ask) and ask about compliance with your request. When they say we've passed it to our client and asked for documents blah blah blah then ask for an extension in the time for YOU to file YOUR defence as per cpr 15.5. Get an email address and confirm details of the call in an email to them for evidence later on.

    You can agree on upto 28 days but bear in mind a defence is not a 2/3 day thing so any 14 day nonsense should be met with "so as the documents are not here i will be getting less time to prepare and file a defence than originally allowed for under cprs ?"

    You should phone every couple of days until you get them or until you only hav 11/12 days left and at that point you should make an application to the court for disclosure.

      Phoned twice and was told someone would call me back to discuss. Not had a call yet, makes me wonder if I have them on the back foot. If I dont get a response nor the letters I suppose I just have to file my defence stating what I have done.

        If you get nothing at all and no agreement to an extension then you will be wanting to apply to the court to order them to give you the documents rather than entering a defence, but again completely up to you. M1 will give you a link to a couple where the CPR request has got rid of the claim (I expect ) or search on pickachu and zhanzibar

          Excellent well I will give them one more call and then at least I have done my bit. I have kept the recordings on my phone so can supply transcripts of the conversations as my exhibits. If they are unable to supply the documents then I can only assume they haven't got them which I would hope would be enough to get rid of the claim all together.

          Thanks again for everyone's help I feel much better now I know a little more about the process.

              Right an update...

              I called again in between meetings and finally got through to someone who could help. I explained I had called twice before and had received no response after they promised to call me back. Anyway cut a long story short they have agreed to a 28 day extension. I got hold of an email address in which I am about to email to confirm the extension and to which date this is valid til.

              What is the best way to inform the court about the extension? Do I email them with a copy of the email agreement of the extension and a copy of the transcript of the telephone call? Or do I have to write to them direct asking for an extension and is there a form I must complete?

                The claimant emails you you forward it to the court with a note of you own - we have agreed to an extension until ... see the claimants confirmation below.

                Don't forget the claim number and the parties names.

                    The fun continues, I still haven't had a letter or an email confirming to the extension. I have called today and same old response someone will ring you back. Tired of all this messing about now. So I think its about time I got the court to get them to provide the documents.

                        I am just putting together all the documents now but I have a few questions about the following:

                        Draft Order for Directions

                        Using the form that Amethyst has kindly put together here: http://www.legalbeagles.info/forums/...ic-information

                        The section:
                        Before District Judge Sitting at the Northampton County Court CC BC, 4th floor, St Katharine's House, 21-27 St Katharine's Street, Northampton Northamptonshire, NN1 2LH, on the ............. day of .............. 2014

                        Do I put the date in from what the claim form says or the day the defence was due to be filed?

                        Do I also need to sign and date this document?

                        I will aim to get the witness statement written and complete by this evening ready for sending via recorded post in the morning.

                        I will also give the court a call first thing to make the payment.

                              I have sent over the N244 form, witness statement & order including all the associated documentation via royal mail special delivery, should arrive by no later than 1pm tomorrow. I rang the court and paid the £80 after trying to convince the chap on the phone for 30 mins that it was the right thing to do.
