        They are nasty bullying gits aren't they, I wouldn't engage with them any further.

        I'll help you sort out the N244 application to amend your defence later on, but if you could check with the court if 1st Credit have responded to them and whether you are expecting a directions/allocation questionnaire.

          Hi,

          If 1st Credit wasnt involved in the PPI misselling then you need to make a part 20 (part 20 Civil Procedure Rules) Counter Claim against the party responsible for the errors.

          In terms of disclosures, you have disclosed the statements, see my thread on disclosure and inspection !!. What they require is inspection, and they are entitled to the same, so i would not withold the documents as long as they have provided you everything you need too.

            Thanks for the information. So i assume that i need to send the bank statments of the dates they have implied payments have been made only. Where do i get the N244 application document.

                        Hi
                        I sent mmy statements for inspection had a letter today stating " they are concerned that my enquiries are becoming circular, as with regards stutue barred debt, they say do i dispute payment of £8.00 on the 13/05/09, and i do not deny payments made in May right through to May 2008.
                        they have supplied another screen print with the suggested payments. All of my bank statements indicate these payments where not made, as well as no information on myy credit files
                        There is no mention of them agreeing to my change of defence.
                        Help need please

                            No payments have been made of £8.00. They havnt ageed to my changing my defence either.

                              Okay well I wouldn't worry too much, you can show you haven't made any payments, you should soon hear from the court with directions or a hearing date and we'll go from there.
