    Hello

    Tomorrow I am in small claims court over a false loan.

    My son has posted on here before and I have made my defence based on the truth and some of the posts I have had on here.

    I am writing to seek a bit of help and mainly peace of mind.

    My ex has claimed that he loaned me the sum of around £4,000, this was a gift as we were still in a relationship at the time and he offered to pay the remainder of the money on the new car after I put mine in part-ex.
    He got his money through inheritance and offered this money. Not once did he say he wanted it back or agree before hand that it was a loan, it has only become a loan after we had split up and he re-married to a "solicitor".

    Any help is appreciated, sorry for any misspelling, I'm getting nervous even though I know I'm in the right

      He doesn't have any paperwork to back up his claim that it was a loan, it only became a loan when we broke up. I never agreed to a loan as it was a gift at the time so no paper work has been passed with me agreeing to a loan from him.

          Yes that is his thread, I started a new one because i thought maybe more people would look at this thread because it was new and had no posts

            Defend Claim - within 28 days from Service (IF you acknowledged in time)

            If you fail to Acknowledge the claim you may have a default judgment awarded against you, likewise, if you fail to enter your defence within 28 days from Service.
