    Hi there I'm just after some advice I'm in court in the morning for a debt of mine for welcome finance. It says for questioning I just wanted to know what this means and if anybody has done this in the past. I'm just looking to see what will be said or done etc.as I'm pooping myself.

    Have you already got a CCJ? Did you ever receive a claim form from Northampton Bulk Centre?

      Hi and welcome to legal beagles.

      I'm no expert and someone with better knowledge will be along shortly.

      Without knowing the history of your debt, circumstances etc. It's hard to advice.

      What does it state on the summons?

        Just says its for questioning about the debt, and yes I've had a ccj against me I had a claim form to send back about do I contest or not. I replied saying no as I no its my fault and needs paying. So just wanted to know what sort of questions will be asked I no if they know I don't have any money to pay them but I'm offering to pay back something then they will question where I'll be getting the money and that answer is my girlfriend will they then ask me for all her finances because I won't give them that its personal information I don't no half the things my girlfriend pays for etc.

          In that case it is probably to determine what you can afford?

          Only from personal experience I ask this, but did you get a form to fill out for income and expenditure?

            Yeah I had that form and I left it blank as it stated only to put my finances down not anybody's else's.

              You will have to provide details of your finances on oath. It's so the creditor can get a clearer picture of your financial position

                I have no financial position I don't work so I don't get pay I'm not allowed benefits so only money I get is what ppl offer to pay for me.

                    Is the hearing for an attachment of earnings means questioning ?

                    If you have evidences of your non entitlements to benefits etc you should take those along with you (eg. letters saying your claim is rejected etc), if you have a recent bank statement / rent book etc then that would be of use too. If you have a copy of the court income / expenditure form ( N56 ? ) I would fill that in showing only YOUR income and outgoings.

                    How come you aren't entitled to ANY benefits ?

                      Im not entitled to any benefits I have a very small pension and get carers allowance that's all.

                        Aye doh!, I just thought about it, if I didn't have the children, then as I'm not currently jobseeking, I wouldn't be entitled to anything either, and everything would be paid for by my OH.

                          Yep seems your single or a couple to suit when it comes to benefits I get £59 odd per week carers allowance the rest the law says I must have to live on is provided by my oh.

                            My OH gets carers allowance which was topped up by Income Support (when we used to be entitled to means tested benefits)

                            So,basically..the OP in this case lives on fresh air,,has no money coming in to support himself?

                              I only claim Carers allowance I have never claimed Benefits in my life the next benefit I will get is a state Pension all of this is my decision.

                              Anyone entitled to benefits should be claiming if and only IF they have paid into the system that's what its there for ,Like many on here I I feel that the system is unfair not fit for purpose and open to abuse
