  • County Court Claim Form - Lowell Portfolio 1 Limited/BW Legal

    Hello,

    I am new to this forum as I have received a claim from from Lowell Portfolio 1 Limited/BW Legal for the amount of £10533.33 and need some help/advice please.

    Despite never recieving any previous correspondances from these companies, earlier this year I found a STATUTORY DEMAND posted through my door from BW Legal acting on behalf of Lowell Portfolio 1 Limited for the amount of £9281.67 relating to debt apparently owed to two companies I have never heard of HBOS PLC and JD Williams & Company Limited.

    I was advised by another online forum to send a CCA request to Lowell and also a copy to BW Legal. I never recieved a reply to my request and this was used to request the STATUTORY DEMAND be set aside at a court hearing. The judge set the demand aside and awarded me a small amount in damages.

    That was 4 months ago and then I received this County Court Claim form for the amount of £10533.33 with nearly £1300 (since the STAT DEMAND) being added on to the debt for some reason.

    I have now submitted the AOS online and have until 19th January to file a defence and this is where I need your help.

      Post up the poc minus personal details.

      Have you done a 31.14 request ? S78 request ? Have your copy of the default notice etc ?

      Acknowledge Claim - within 14 days from Service

      Defend Claim - within 28 days from Service (IF you acknowledged in time)

      If you fail to Acknowledge the claim you may have a default judgment awarded against you, likewise, if you fail to enter your defence within 28 days from Service.
