    What do you mean? Their directions?

    Im at work right now so dont have anything, but i cant say that the latest date to have received evidence was 16th may.

    Indeed it is. There are rules to prevent it.

    Can i email this lot to someone please becuase its a odf and i cant c and p it here. But it looks crazy. There is a signed CA from 2001. Last direct debit payments were 2007. Then theres two spurious tid bit payments 2010 and 2011. I did not make those. And theres now suggestion of how the payments were made.

    They reckon £10.39 was paid in 2011. Absolutely no chance.

    £3.73 in 2010-funnily enough apparently 2 weeks before i had a baby. These are made up figures

    They have sent me an email with the defence. ONE day hefore the hesring. Wtf.

    They say the solicitor will not be at the hearing but a local rep will be.

    I say the judge twisted normal law and twisted it beyond breaking point. It actually goes against the BPA code of practice and as members the have to follow that or breach CPUTR 2008. Admitting to that breach in court is an interesting move !

    Don't forget to take that evidence with you and tell the judge. Of course that's if they don't turn up. It can also apply if they do turn up too!

    In all honesty i think 25 hours would be a very low figure given the amount of reading i have had to do in order to write my defence but id be happy to get back my out of pocket expenses and the working hours i will lose. As i say, its all coming out of the leave i have saved for my wedding .

    I think they other side have been unreasonable too, they never answer letters or provide documents they are supposed to provide, they don't follow the correct practice direction, have ignored the DJs direct orders and they (probably) know that they wont be turning up on friday and to hell with letting anyone know. Cowboys!!

    If you can explain 25 hours then yes.

    The court might try and give you £90 for a working day but that is standard and you're asking them to use powers they have when 1 party behaved unreasonably

    Gotcha thanks. So should i list 25 hours x £18. Plus work time of 4 hours x£18 (leave im taking). Parking at £7.50. 2x registered post, 2x postal orders, 2x £6.15 on overnight delivery of evidence.

    Cant see me getting much if that back from them.

    There is a maximum yes. I think, if i recall correctly, a limit of 2/3 of the cost a solicitor would charge.

    Do we know if lowells have a habit of not turning up?

    It could,be they take a chance on the hearing fee thinking the LIP wil cave in in the 11th hour. I dont know, just clutching at straws ( a fine album too btw)

    Goodness really? They'd never pay me that back surely?
    is there a maximum? Whilst ive spent ages on this, i dont want to take the pee and risk not getting anything back.


    The court is closed now so i will have to ring them in the morning. Friday will be fun, i have physio on my hip so ill be hobbling in on my walking stick like an old witch!
