Re: Help please efending court claim Arrow Global/MBNA
Sorry for the delay. Spent yesterday under the stairs sorting out paperwork !
I requested a list of charges etc on 6th September 2008.
PPI refund request on 10th October 2008.
Several refusals and counter reponse disputing refusals.
SAR request Dec 2008.
Notified MBNA in writing of my financial difficulties due to illness dec 2008.
DCA's chasing.
Default Notice from MBNA 09/08/10.
Aegis Limited offered 60% settlement £2,635.37 on 03/12/10 (still couldn't afford due to not working because of illness)
Still no response from PPI.
Constantly being passed on to other DCA,s.
Eventually Received refund of PPI in October 2011 by cheque (No charges or interest were included)
requested a break down but never received one.
I disagreed with the amount refunded. The account had not been reconstucted.
letter each month from Rockwell DCA (March -June 2012)
Fenton cooper July 2012
Blake Lapthorn October 2012
I have neither spoken to or written to any of the above.
Nothing directly from Arrow Global until
Court Claim received.
I can not find an assignment notice and to my knowledge I have not received one.
What should I do now with regards to acknowledging court ?

Re: Help please efending court claim Arrow Global/MBNA
MrsJ - please give Militant's suggestions the priority here, as I don't want to side-track that with this post. But - when you have the time - it looks likely that you may have been 'diddled' with a dodgy PPI refund offer. If you banked the cheque, but rejected it as a full and final settlement, then there is a possibility that we can still further this aspect, and put the claim into question. Being given insufficient info as to how a PPI settlement offer has been calculated is a breach of the FSA guidelines on PPI Redress in PS 10/12:-DISP APP 3.9.4 The firm should make any offer of redress to the complainant in a fair and balanced way. In particular, the firm should explain clearly to the complainant the basis for the redress offered including how any compensation is calculated and, where relevant, the rescheduling of the loan, and the consequences of accepting the offer of redress.

Re: Help please efending court claim Arrow Global/MBNA
Thank you Bill K, I have had so many issues with MBNA that I may be able to use as defence ? but not sure so will need assistance.
What should I put on the on line acknowledgement of service as my defence ?

Re: Help please efending court claim Arrow Global/MBNA
do not touch the defence
as its MCOL .the N1 court claim, you should have a password to log into MCOL
send that CPR 31.14 WITH IMMEDIATE EFFECT to ARROW
are they using a solicitor, if so, send the cpr 31.14 to their solicitors
acknowledge the claim online, that is all,
in that you will be defending in full

Re: Help please efending court claim Arrow Global/MBNA
Sent CPR31.14 to Blake Lapthorn on Monday 29th Oct.
Checked Track & Trace at post office BUT it states " Posted at **** on 29/10/12 and is being progressed through our network for delivery."
Can't believe its not there yet ?
Should I resend tomorrow by Special Delivery.
