  • CCJ claim from Restons/HFC Bank

    Hi there,Some advise needed if possible, please.I have a debt through HFC bank which Reston's have issued a CCJ for through Northampton CC. I have accepted the claim as i do owe the money, i wantot pay it back and am unhappy it has gone this far.cutting a long story short, i missed a payment on the CCJ and Reston's have sent my file for enforcement which will cost me more money.What can i di now as i do not have the money for the fee for the N244 form and payday is 3 weeks ago. Is there anything i can do to stop the claim going through until i have sufficent cash?

    If you are in financial difficulty then you may get a fee remission on the N244 application fee.(form EX160 from Her Majesty's Courts Service - Home

    Yes you should apply for redetermination.

    How much is the debt ?
    Do you have a copy of the Judgment Order / agreement with HFC to pay monthly ?
    On the original claim do you recall if they charged you an extra lump called a 'collection fee' ?

    Have you received a notice of enforcement from the court or have HFC just told you it is going to ?

      Thanks for the reply Amethyst.The original debt was for £561.38 but including charges the debt gone court for Reston's was £726.38 (costs of £165) of which i paid my first instalment of £50. I have the orignal judgement for claimant acceptance notice and have recieved a notice of transfer proceedings letter dated 30/12/09 that the debt has been transferred to Coventry CC for enforcement.I have completed the N245asking for more time and to reduce the monthly instalment ot £40 per month.
