  • Court Claim PRA group no letter before claim

    Hello,

    Wondering how best to proceed here.

    I have received a claim form from Northampton County Court Ref a debt from PRA group. However this is the first piece of correspondence I have had from PRA group. No letter before claim or anything like that. I have emailed PRA group stating this and asking for the original CCA. Should I send the acknowledgement to the court? or dispute jurisdiction? Who do I send the documents to?

    Total Amount Claimed : ( approximately please do NOT use EXACT figure given on the claim form, round up to next £100 or £1000)

    Original Debt (eg. Credit card/Loan/Overdraft) :
    Particulars of Claim: ( Please type out in full excluding names/account numbers/exact amounts ):
    Is the debt Statute Barred (have you had any contact with the creditor or claimant over the last 6 years?):
    List any letters you have sent (eg: CCA/ CPR ):
    Any Other Information or Background Details:

    A) Send a 31.14 request to the solicitors on the claim form, they have 7 days to respond after receipt of letter. Make sure you get Proof of Postage.

    B) Send a CCA request to the Creditor, they have 12 days to provide a copy of the agreement, make sure you get Proof of Postage (you need to do this again).

    c) Send a SAR to the original creditor, they have 30 days to provide all the data on the account, make sure you get Proof of Postage.

    You need to lodge your Defence with the Court within 28 days providing you Acknowledge Service of the debt within 14 days. You can file your Defence via MCOL (although you have 5 days for postal). Do not forget. Update the thread when you get the requested information.
