Email them, ask them if they can rearrange it for any date, but after 3.30pm you would be grateful.

They should have provided a copy of the Default Notice in your CPR 31.14 request.

Did the Claimant pay the fee?

              Did the Hearing go ahead?

              Ring the Court?

Then we received another letter today from Overdales please see Attached Pics

We refer to the order from District Judge on 8th July 2025

Please see enclosed by the way of service the claimants witness statement. We confirm the same has been filed with the court and another hearing date has been requested with amount due £3907.93

I dont know whats going on it doesnt make sense

We were willing to go to court heard nothing then got this letter today stating amount due £3907.93

Then they say they want £3561.93 which is the original claim

There asking for it to be struck out in there favour

Also theres no mention of Capital One

How do i defend this ?

                Thanks as always

Sorry we've had a lot going on and thought that was the end of it and forgot all about it

Hope we didnt mess up by not going or contacting the court

From the 10th October 2024 to 15th July 2025 there are no updates from you.

It's not great posting a letter from May and saying you would of attended the Hearing.

The whole point of replying to your posts is to give you control of your case, now it's trying
to get it back on track.

Ring the Court for an update.

Not at the moment, you need to find out exactly when the Hearing date is and any other information they can provide.

                            I phoned the court

Was told that they paid the fee on the 11th June

As we didnt know this and didnt chase it up as we thought they had not paid and that was the end of it we did not attend the hearing

Apparently the hearing went ahead but cannot tell us what the decision was and we will have to wait until we receive the letter which could take up to 6 weeks to receive

But we have received a letter from overdales dated the 15th July

We refer to the order from judge on 8th July

Please see enclosed by the way of service the Claimants supplementary witness statement and another hearing date has been requested

So fingers crossed we can still go to court and fight this

                            Thanks

What you need to do is prepare for the Hearing,
Prepare a Witness Statement with evidence, a copy needs to be sent to the Court
and their solicitors at least 14 days before the Hearing.
You can object to the lifting of the stay in your Witness Statement with other points.
You need to do this now.
