O.K. there are three accounts rolled into one claim, so the Witness Statement has to deal with each account.

So the Witness Statement will need headings etc.

Also would it help if i put in my statement that my gf works as a support worker in local hospital and has had to reduce her hours to the min allowed because of health issues Diabetes and more recently since 2021 when she caught covid and now suffers from anxiety depression and is on medication for this and is also under the hospital for chronic migraines & headaches and has recently had a probe inserted in her brain to find the cause of them and the fact this court case is causing here even more anxiety

Also i will have to talk on her behalf because she will not be up to it

That's fine, you have time.
The Hearing is on the 11th September, so aim to get it done by the 20th August, sent / emailed to the Court and Overdales by the 27th / 28th August.

its from a previous address when we took out the agreement

Have they provided variation terms and conditions i.e. if the APR goes up etc?
Apr is 17.9% variable and the credit limit is £1500

Have they provided a Default notice?
No never received one

Check the letter of assignment for errors?
We never received one from paypal only one from Lowell on non headed paper saying it was transferred on the 21/09/2023 but on there letter dated 12th july 2024 theres no mention of date to when it was transferred to lowell but both capital ones do provide a date

We just have a credit card agreement and says APR 35.9% APR variable its hard to make out as the writings so small

yes was sent on the 12/11/2022 the a statement of default 15/12/2022 but overdales say that the default date provided to our client was 14/12/2023

Check the letter of assignment for errors?
just says it was sold to Lowell on the 21/09/2023 but on another none headed paper its saying it was sold on the 22/09/2023 dont know if that makes any difference
