    Issue Date: Thursday 30th November 2023
    Have you Acknowledged the Claim?: No
    Total Amount Claimed : (£3300) approximately please do NOT use EXACT figure given on the claim form, round up to next £100 or £1000)
    Claimant’s Name: Lowell
    Solicitors Firm: Overdales
    Original Creditor: PayPal Credit
    Original Debt (eg. Credit card/Loan/Overdraft) : Credit Card
    Particulars of Claim: ( Please type out in full excluding names/account numbers/exact amounts ): Non-payment of said debt; even though this debt has been sold onto Lowell's from PayPal and I have not acknowledged this debt. Have been in default for close to 6 years, however not entirely sure of the exact timeline. Other debts (due to be statute barred) around this time would suggest this.
    Is the debt Statute Barred (have you had any contact with the creditor or claimant over the last 6 years?): No/Not Sure
    List any letters you have sent (eg: CCA/ CPR ): None
    Any Other Information or Background Details: I am almost entirely sure since I originally defaulted on this debt to PayPal and they consequently sold on thos debt to Lowell's, that they pushed the date of default forward, in their favour.

    You need to post what's on the claim form under Particular of Claim, not your summary.



    a) Firstly Acknowledgement of Serivce, this can be done online via MCOL, you are denying the whole debt.
    Acknowledgement of Service gives you 14 + 14 days,

    b) Send Lowells a CCA Request, make sure you get Proof of Postage.

    d) Send the original creditor a Subject Access Request. Make sure you get Proof of Postage.

    Work out when your defence has to be lodged with the Court and the Claimant, aim for within 28 days, make a note in your diary, don't forget. Post on this thread 5 days before your Defence is due, so we can take a look.
