Do I just negotiate a plan with the creditor now before it ends up back in court?

Summarize where you are with the documents you've received.

I've managed to scan them all. I would say the scanned versions are less clear,

          Can you see anything?

              I have asked for:

              1. Agreements (I assume thats the Fixed Sum papers I mentioned above?)

I can find your name and address on those, can you check that?

              2. Default Notice - NOT RECEIVED

              Not received

              3. Deed of Assignment - NOT RECEIVED

They won't give you that because of commercial reasons.

              4. Notice of Assignment - NOT RECEIVED

              They've now provided them.

I couldn't open them earlier, mostly the same docs, the agreement has your name and address, I presume that info is correct.

So they haven't provided a copy of the default notice. You requested that in your CPR 31.14, is that correct?

I did request it yes. I just checked the previous documents they sent, and again, no Default Notice, although they say it is enclosed.

The Judge has considered the statements ............claim allocated to small claims track, parties referred to Part 27 Civil Procedure Rules.......... encouraged to settle....listed in person 23rd May......

Does it say anything about Witness Statements?

It sounds like a case management Hearing, you could ring the Court and clarify.

It might be an idea to provide the Judge / Court and Kearns with a Skeleton

Argument, 72 hours before the Hearing. No doubt the Kearns will do the same.

Go through the thread as well as the knowledge you have about your case, then you can
work on your Skeleton Argument, this will help you during the Hearing.
