    I done it via MCOL. Is that enough?

    Should I send them a copy when I come back, or before I go? Is there a benefit of sending it them later?

      Send it before you go (I mistakenly thought you had gone).

      The time for filing your Defence has passed, so you need to call the Court for an update, do it before you go.

        So here we are now. They did not provide what was requested for, well not to me anyway,.

        what does this mean now?

          a) The first letter states they will take Legal Action, if you don't respond, it's dated 8th Dec and gives you 14 days, they've taken legal action, so, you can file that away.

          b) The second letter states the Courts have received your defence, so you can file that away.

          c) The third letter is a statement of account, that's dated 26/12/23, not the information you requested, so you can file that away.

          d) The fourth letter is a Court Order, you need to fill in / send the Court and the Creditors solicitors the Directions Questionnaire you have received by 15/01/24.

          If you haven't received the requested documents (bearing in mind, they were requested late), you should say yes to mediation, but add that you are awaiting documentation from the creditor.

            So am I saying yes to mediation upon receipt of said docs knowing they may well never produce them, therefore showing the courts I am cooperative?

              Yes, but just be aware, you may lose the opportunity for mediation.

                which one of those questions do I mention I am waiting for documents? it’s only asks me to fill out extra if I say no to the question,

                        Answer No, reason being that you want a Hearing in person, so you can explain the evidence / documents in detail.

                        Have you got room under the following to add that 'you want mediation, but haven't received the requested documents.from the Claimant or their solicitors'.

                        'Do you agree to this case being referred to the Small Claims Mediation Service? ….. YES'

                        You can email the Directions Questionnaire to the Court (in subject line, write the case number, Defendants - Directions Questionnaire - XXXXXXXXX v XXXXXXXX. Make sure you post a copy to their solicitors, make sure you get Proof of Postage.

                        (I'll always answer but might take a bit of time)
