  • claim form

    i have received this letter today and i’m a bit confused about what to do? i’m guessing i defend it ? but i’ve had no contact about any of this at all, and they sent it to a previous address ?

    sorry it will
    not let me upload the letter - basically it says it was issued in jan to an old address and now they are sending it to me . they go on to say i now have until 18th april to respond . it’s not a proper claim for issued by the court and they do not have a copy of it . they have just sent me a response pack.

          So it's basically a letter before action, threatening a Court Claim?
          What kind of debt is it? i.e. Credit Card? Council Tax etc
          When was the last payment made?
          When and how was the last contact made with the creditor?
          Any background information is helpful.

            The OP does say Claim Form, but has yet to return with more detail.

                    O.K., you've received a Court Claim form in January, you've only found out about it from the letter they've sent, they are allowing you to respond by the 18th April.

                    a) If you can answer the following questions, copy / paste the answers back to this thread (without personal details):

                    Received a claim? Yes/No:
                    Issue Date:
                    Have you Acknowledged the Claim?:
                    Total Amount Claimed : ( approximately please do NOT use EXACT figure given on the claim form, round up to next £100 or £1000)
                    Claimant’s Name:
                    Solicitors Firm:
                    Original Creditor:
                    Original Debt (eg. Credit card/Loan/Overdraft) :
                    Particulars of Claim: ( Please type out in full excluding names/account numbers/exact amounts ):
                    Is the debt Statute Barred (have you had any contact with the creditor or claimant over the last 6 years?):
                    List any letters you have sent (eg: CCA/ CPR ):
                    Any Other Information or Background Details:

                    b) If you haven't acknowledged the claim, do so online via MCOL, you are denying the whole claim at this time.

                    c) Send a 31.14 request to Overdales, they have 7 days to respond after receipt of letter Make sure you get Proof of Postage.

                    d) Send a CCA Request, they have 12 days to respond, make sure you get Proof of Postage.

                    e) Your next step is to get your defence done by the 18th April and emailed to the Court , also send a copy to Overdales.

                    This is an example defence, amend it, copy and paste back onto this thread (leave out all personal details) so we can take a look at it.

                    ccbcaq@justice.gov.uk (you should get an automatic email from the Court acknowledging that they have received it)

                    In the email subject line write - Claim No: XXXXXXXXX - DEFENDANTS DEFENCE - XXXXXXXXXXX V XXXXXXXXX

                        i’ve tried to acknowledge this via the online portal but i don’t have a defence pack password. all i have is a acknowledgment of service form to fill in. via post?

                          That's fine, send it by post, make sure you get Proof of Postage.

                            thank you , if i say i need the extra 14 days how do i work this out is it from the date of the letter ? or the 15th april they said they are giving me until ? to do the defence

                              It's the date of extension 15th April, do your defence, copy and paste back on this thread (without personal details), then I can check it before you lodge it with the Court.
