  • Awaze - county court claim

    Hi
    Last year, I booked a holiday through via Hoseasons for August 2022, but cancelled due to my husbands ill health. I paid a 65 non refundable deposit via debit card (card now expired) however I've now received a county court claim claiming an extra £140 from Awaze rental group, who I believe are part of Hoseasons They state said they've made attempts to contact me via email, however i have received nothing and the email attached to my Hoseasons account is my old email, so it may have gone into my spam. I have received no phone calls or letters. Does anyone know if i have any rights? I don't want a CCJ.

    Hoseasons are part of Awaze.

    Exactly which Hoseasons company did you contract with?

    Have you checked the cancellation terms of that particular Hoseasons?

    Could you please post up the "Particulars of Claim"?

      What reasons does this claimant give for asking you to pay this money?

        Thank you both so much.
        I’ve attached a picture of the Particulars of Claim.
        Its parts 3&4 that I’m confused about because I’ve received no contact.
        I will acknowledge the claim today, however once this has been done would i need to make a SAR to Awaze?

          In which case you should dispute those paragraphs.

          What do you say about paragraphs 1 and 2?

          NB - I think a judge may well say that it is your responsibility to check your spam folder. Following a near miss some years ago, I check mine daily. Every now and then something important is in there.
