    Lowell solicitors trying to mislead me. feel like I should try and find a way of including their behaviour in my defence.

    "What you need to do now

    You need to respond to the county court claim by the date specified on the claim form. When you register at www.lowellssolicitors.co.uk, you can respond to the county court claim online"

    As a regular reader of these forums I was aware this wasn't the way to respond to a claim, however I can see others being fooled by it. perhaps an attempt to get judgement by default.

      Already done it. been expecting the claim for the last few months since they sent the letter of claim. came a little sooner than expected though. they haven't supplied the default notice or notice of assignment i requested when replying. wrote to me telling me account suspended until they comply. then a claim form arrives.

      fortunately as id been expecting a claim, I've been saving all their letters. I must thank them for the gift of allowing me to claim they haven't followed pre action protocol.

      Acknowledge Claim - within 14 days from Service

      Defend Claim - within 28 days from Service (IF you acknowledged in time)

      If you fail to Acknowledge the claim you may have a default judgment awarded against you, likewise, if you fail to enter your defence within 28 days from Service.
