  • Lowell &CPR31.14 request information

    Hi all I have read through posts and just want to confirm I am asking for the right information and not to much.

    i am completing my CPR 31.14 this morning to post today

    i have attached an iamage of what is in the Particulars of the claim am I asking for the 2 agreements only or the 2 agreements and the termination of agreements and assigned to claimant.

    any help would be great

      Agreements ( capital one and vanquis )

      Ask for the notice of assignment and termination/default notices too, although strictly they aren't mentioned as documents they are mentioned in that assignment and termination happened.... so it's still a good idea to ask for them.

      Also send two CCA requests to Lowell, both with a £1 postal order, one each for Capital One and Vanquis accounts.

          I have just realised, The account number they have entered for the Vanquis card is different to the Account number I have. Does this make it Unenforceable ? As I understand it once you have put a Claim in, if the amount is incorrect or the account details it is unenforceable and they cant re-apply is this true ?

            No.

            The card number / account number will change over time and when the account was sold from Vanquis to Lowell they may have assigned a new account reference to it.

            The claimants haven't plead that the accounts defaulted or that a default notice was pleaded. So you certainly want to be asking for the default notice.

            The CCA requests are important too - they will need to produce true copies of the original agreements.

              I see, well I sent off the CCA's and the SAR's on Monday so lets see what they have.
