    Hi guys and gals

    this is my first post so please bear with me here

    i stupid got over my head on pay day loans back in 2013

    I have received a CCJ from BW Legal from PayDayUK on the 08/08/19
    I got the payday loan in May 2013 but never paid a penny of it but memory isn’t really great whether I had a previous loan with them that got paid and this one was a second or third agreement with them. I have acknowledged any letters from this agreement and was 3 months away from it dropping off my file.

    My questions are I guess how good of a case do I have in trying to get it stroke off from the court in my defence claiming it’s statute barred?

    On my credit file it stated that they defaulted me on 30/11/2013 but does this date count as the start date of 6 years or is it from the date of first non payment? This is very confusing

    I have looked at the templates you can use online but there just a confusing haha

      6 years England/wales from the last contact with them? 5 years Scotland

        Have you received a court claim or a judgment ( in default )?

        If a court claim you you need to acknowledge it with intent to defend and send off a couple letters as per https://legalbeagles.info/library/gu...y-court-claim/

        Does sound like it should be statute barred if it defaulted August 2012.

          It didn’t default until November 2013. I’ve received a CCJ claim dated the 08/08/19

          its very confusing when the 6 years starts from I don’t want to argue the case if it’s going to be disregarded I suppose

            It also shows as PRAC Financial on my credit file too if that’s any help and BW Legal are doing the CCJ

              You've received a claim, not a CCJ ... a CCJ is a judgment

              send a cca request to PRAC and a CPR request to Baw Legal - if you can type out the particulars of claim from the claim form it would be helpful to know what to ask for.

              IF it defaulted Nov 2013 then they're probably in time.

                Ok so to follow up and get some more advice now I sent BW a ccs request as well as PRAC it was sent on the 20/08/19. Not received anything as of yet and it has been more than 12 working days

                what do I do next?

                  Confused about the whole story.

                  If you have received a claim form you need to crack on & submit your defence.

                    a defence gets sent off two days before deadline so as to not get it rubbished by claimant, too early is dangerous

                      Ok so I have submitted my defence as they never sent me the original default notice from payday uk but They sent me a couple of letters saying they are preparing my request and should receive shorty but nothing as of yet.

                      ive also received a letter from the court saying they’d acknowledged my defence

                      so my question is what’s next?
