I've recieved a letter at the weekend from a company I've never dealt with called link financial.
The letter was stating I had a judgement in arrears.
- We have previousily writtent and attempted to call you regarding your account (they have never mentioned a judgement in previous letters - just that I owed them money without saying where it originated from)
- We are sure there is a good reason for not making contact with us and that you intend making payments to clear the outstanding balance.
- Please call us on 02920 858710 so that we can discuss your intentions and agree an afforable repayment plan to clear the outstanding balance. We are here to help and want to be able to understand your financial circumstances, so that we can agree a replayment plan that is realistic and fair to you.
- However, if we do not recieve contact from you within 14 days the account will be passed to Messrs Kearns Solicitors without further reference who will be instructed to take enforcement action,
Through Attachement of earnings / order to obtain information / warrant of conrol

Now I've never knew that I had a CCJ with anyone and I have looked it up and in November 2013 there was one granted for £1395 at Northampton Court. It does not say on my credit file who it was through but I think its an old Weclome Finance unsecured loan I stopped paying years ago due to the amount of fees they had put on my account, which meant after I had paid for around 2 years (which was the full term) I still owed them most of the original £1500 loan. It then got passed to Lowell and then after making some payments to them on payment arrangement I stopped and it went past the statute barred period. I then moved home around April 2013 and over the last year have had letters from link asking to get in touch with them and sometimes ones saying I owed so much money and need to pay and not saying who or anything, and this letter was titled Judgement xxxxx in arrears and the judgement is there to see on my credit file after I have moved.
What do I need to do, I think I need to get this set aside as it was statue barred at the time they took me to court and also I did never recieve any details of the judgement which I definetally would of sucessfully defended if I still lived there.
What letters do I need to send link to put the enforcement on hold as do not want a attachement of earnings.
What do I need to do to get the CCJ set aside and can they enforce it while I'm waiting or will that put a hold on things for me also. I can see the N244 form but seems quite general and could be used for alot of things other than just setting a judgement aside.
Should I also send CCA/personal data requests to Welcome Finance, Lowell & Link to see what information and my previous account details as I dont have any of my own records with it being such a long time ago.
Any help be great as I need to get moving on this before it is too late.
