  • Court paperwork sent to old address

    A false claim of a car incident was made against me. I advised the claimant that I would contact my insurance company to explain nothing has happened and the lady was in fact crazy. Unfortunately my insurance had lapsed.

    I then recieved a letter letter from the MIB requesting details of the incident. I responded in April 2017 that i was not involved in the accident and that’s i had an independent witness. I heard no more.

    I have now now recieved a letter from their solicitors claiming that’s I owe £4200 for personal injury! Of a accident that didn’t take place. I called this company and they said that all paper work where I could have defended myself was out of time and that the claim was settled. The problem is the paper work was all sent to my old address.

    I am am on the electoral role at my current address and have only recieved the new letters chasing for the money here. I never recieved court letters nor a letter dated in Oct 2017 which they have now sent a copy stating that I admitted liability by responding via txt that’s i would contact my insurance company. This is not admitting liability.

    This is was the one and only week my insurance had lapsed in my whole life of driving.

    Have they provided you with copies of the paperwork ? If not ask them to do so, if they refuse ( which would be a tad irrational of them considering they want paying ) you can send them a SAR Subject Access Request Letter

    You can also contact the court, likely Northampton County Court Business Centre, if there has been a court claim and judgment against you and ask for copies of the documents - they sometimes charge £10 for this.

    Then once you have all the information you can look at trying to rectify matters.

    With regards the car accident, is it a case that you weren't in the car at the time of the alleged incident, the car wasn't involved in any incident and was elsewhere that you can evidence ? and was there damage to any vehicle involved, or just the 'injury' ?

    Do you have copies of the letter MIB sent and your response from April 2017 ?

      this sounds a bit odd.

      Whose solicitors are chasing you?
      MIB would either defend a court claim (in which case they would want you there) or pay out if they thought you were in the wrong.
      I just wonder if the claimant proceeded to court against you at an old address hoping to get a default judgement.
