  • GDPR request being refused for lack of signature.

    I've just come to the end of a 12 year secured loan.

    The loan was sold to a different lender halfway through (Black horse to skye loans)

    I want to double check fees etc throughout the life of the loan and have GDPRed both BH and SL.

    BH are processing the request. SL are stalling.

    SL have written saying they refuse to supply GDPR because there was no wet signature on the request (their words).

    I have pointed out under the terms of the GDPR I can request it by email and then there would be no wet signature anyway.
    That my signiture has chaged and does not resemble the one I used 12 years ago.
    And also that they will not have a verified signature of mine as I've never supplied them with a signature.

    SL have never been able to supply me with an original copy of the agreement showing my old signature so I doubt they even have a copy of it.

    Is there any requirement for a GDPR request to be signed?

    They have 10 days to complete my request if they still refuse can I complain to the ICO afterwards?

    Under GDPR you can request it by phone or text, or even Twitter, so no there is no requirement for a signature.

    They can request ID to ensure you are the person you say you are ( to protect your data being sent to random people who happen to ask for it ) - as you say a signature won't prove that at all.

    Personally I'd just sign the letter though.

      You can actually make a subject access request orally too, so I don't know why they are asking for a wet signature. In fact, typing your name at the end of a letter can also constitute your signature as does your name at the end of an email - this has been the case since 2000 when the Electronic Communications Act 2000.

      Data controllers do have a duty to verify you so assuming you provided them with identification at the time i.e. a driving licence then Skye Loans would ave to come up with some other excuse not to comply.

      If you want to drag it out and not provide a signed version of the letter, then complain to the ICO afterwards but if you are needing the information sooner than later, sign the document (maybe a squiggle or signature not yours because they won't know what it looks like).
