  • Ccj claim/moriarty law/mmf/wageday advance.

I received a county court claim from moriarty law on the 9th of August.i have followed your advice regarding defending claim. I also sent a cca request and a cor request to mmf and moriarty on the 8th if septemver 2017. I received an acknowledgement for both requests. I still have not received any of the information I requested.
I have now had letter from court telling me this is now a defence case and the questionaire to fill out.
I need help on what to do next as moriarty and mmf have failed to supply what I have requested

Hi, if you have filed a defence you simply need to fill in the defence questionnaire to say you'll accept mediation (always best as you look reasonable), you don't dispute jurisdiction of the court and you want the hearing in your local court, make sure you fill in the court name and address.

Return that to the court and then a hearing date will be set.

My posts here are based on my experience of a variety of life events. I have no formal legal training & if in doubt take professional legal advice or contact CAB. If you follow anything I write here you do so at your own risk & I accept no liability for any loss, costs or other outcomes.

Did you have other payday loans from WageDay Advance? Or any other payday lender? If you did, you should consider whether you can ask for a refund of the interest as the loans were "unaffordable" - see https://debtcamel.co.uk/payday-loan-refunds/ for details.

This is in addition to defending the current claim, not an alternative... but it may give you the money to pay the CCJ if you lose the case!

Today I have received an email regarding mediation appointment. I am happy to take part in this but mmf and moriarty law still haven't sent me the information I requested on September the 8th. How should I proceed as they haven't sent information requested to aid with my defence.
