    Hello,
    can you please advise if it is normal for a claimant to request the courts to issue a judgment against a defendant without submitting particulars to support the claim?

    LOWELL being the claimant did not submit any evidence or credit agreement to support its application for a CCJ judgment against me.

    is this acceptable or can I use this as a ground to request a set aside alongside my defence that the debt was not owed?

    So did you respond to the court papers?

    A claimant cannot just request the court to issue a ccj.

      The truth is that I did not receive the court claim pack as I was truly looking forward to having my day in court to defend Lowell’s claim it it ever went to court.

      My address has not changed. Other than the evidence that I was out of country at the time the judgment was entered, I do not have proof to support my argument for non receipt of claim form.

      The amount of the claim was less than £100 before it went to court and I was adamant that this was not owed and going to court to dede d this would have been so easy for me s I was gutted that I did not receive the court’s notice.
