    Re: MKDP v Kandis

Monday the 27th at 4pm. I hand delivered mine, and the Court Clerk told me nothing was there from them at 3pm. I'll phone the court or write to them.

Still not a dicky bird from MKDP. They have only two posting delivery days as Monday will be too late, as our postie always delivers around lunchtime! The Court have not received anything either. Getting a bit nerve wracking as no telling which way the judge will swing!

        Re: MKDP v Kandis

Is it worth doing a letter to the Court along the lines what Eskimo did and hand deliver it tomorrow? Is this too late seeing as court date is Monday??

          Re: MKDP v Kandis

They are cutting it very fine - they may pull out just before, just not show up, or they may show up and try get the docs in under the door. Are you going to be able to go on Monday ? If not then you MUST write to the court with your information, argument and why you are unable to attend. Have a look on Dizzy's thread for that.

            Hi Ame,
Yes I can go Monday - that's not a problem. But I really wanted to get a letter to the Judge tomorrow saying along the lines I've had nothing, they've abused the Court Order etc etc! Or shall I just turn up and hope I get a nice judge?

              Re: MKDP v Kandis

Ok cool Ring the court again tomorrow afternoon after 3pm before 4pm and again Monday before you set off for the hearing. You really have done everything you can.

If they do turn up remember ' under section 77-79 of the Consumer Credit Act 1974 for a copy of the Consumer Credit Agreement (Exhibit B) with payment for £1. To date the Claimant has failed to supply me with a true copy of the credit agreement. '

If they produce it on an Ipad at the hearing tell the judge you have not seen it and you'll need to adjourn to assess it and amend your defence and the claimant pay the costs of that.

If they don't show up, ask him for costs for the day - travel, parking etc. and ask him to strike them out as they have had more than enough opportunity since bringing the claim nigh on 6 months ago.

Helloooo, just about got off the floor! OK, the legal rep wasn't a pleasant man, wore a pink bow tie!! tsk! Anyway....case is adjourned. MKDP sent their bow tie man with documentation! Pfft! I immediately said why wasn't this done on the due date like the Judge asked! He was a nice judge. Judge, adjourned the case for defendant to go through the documentation. No costs to either side. Will wait for next order. I will scan up all the info tomorrow or send to Ame. No CCA, but there is an application form. The terms and conditions are definitely not the originals. Having a large G&T as feel a bit deflated with MKDP obvs p... take of the orders all over the UK not just mine!
