    Well, heard not a dicky bird from court re MKDP's defence. All I've had is a letter from court stating they have received my defence and that's it.

      Claimant has 28 days to respond to the court stating whether they wish to proceed with the claim after receiving your defence, if they don't respond, the case will be stayed.

        Mmm got notice of allocation to small track today. Still no compliance to my CPR request!! Philistines they are! Will scan what I got through the post tomorrow.

            Phone the court. Once allocated it's pretty much a case of wait for the court to issue direction which includes a trial date.

            Cpr request = dead.

                lol, M1 means that once you are allocated the case is dependent on the defence as opposed to on the CPR request as that is only valid preallocation thus the CPR request is umm dead now.

                Did you get a directions questionnaire to complete? (N181)

                    The reason the request under CPR 31.14 is dead is because Part 31 of the CPR does not apply to the small claims track so you can only argue non-compliance before the case is allocated. :ohwell:

                    Most claims below £10k are allocated to small claims, the N180 questionnaire should be pretty straightforward. This PD gives a little background info on the small claims track: http://www.justice.gov.uk/courts/pro...rt26/pd_part26

                        Yes sorry was thinking you were in fast track, fill out the N180 and return to the court.

                        Should be pretty self explanatory but shout if you get stuck.
