          Re: MKDP v Kandis

Actually as they have particuarly mentioned complying with preaction protocols, and actually haven't - I'd add in a bit on that in the CPR request.

          1. Agreement
          2. Default Notice
          3. Assignment
          4. Compliance with Pre Action Protocols

Okay Let us know when you hear back from those letters - or if you don't then come back at least 7 days before the defence is due in as we may need to chase them for an extension or apply to the court for an order, or submit a defence of course.

                Hi
Just checked on-line credit report, found out Barclaycard was opened in 11/4/1985...damn out of the time frame?

So just to be clear in my head, date of issue was 1 May 2014. Date of service 6th May so defence needs to be in 2nd June.

It would be (only just), if the date above was accurate, but is it? :noidea: It's been nearly 30 years! Let's see what arguments Barclays come up with. :tape2: :tape:

...especially in view of the fact they can't even retrieve 8 year old agreements...

It's 33 days in total, so you're spot on.

Thank you FP, if they can't provide 8 year old agreements then 1985 is looking very unlikely - I hope! Will see what they produce (if anything) from my CPR request!

                          Hi
An update, they received CPR and CCA on 14th May, 7 day deadline is today and nothing in the post. They cashed the CCA cheque yesterday (19th) What's do I do next please? Apply for an extension? Thank you in advance

                            Hmm

My approach would be to go for an application for an unless order (that they either supply the docs within 7 days or the claim be struck out

You will find info on 'next steps' in the post you took the original CPR 31.14 information from

Hi, I'm getting nowhere fast with an extension on defence which is due on the 2nd June. I have emailed them four times now and no response whatsovere. What shall I do now please? Go for Unless order tomorrow and submit defence on Monday? Getting quite worried now. Thanks

                                Re: MKDP v Kandis

and nothing back on your CCA request yet either?

Are they just ignoring emails asking for the extension agreement?

So if they don't agree, and considering recent events in court, I think we should just go with a defence along the same terms as the application would've been.

To go in Friday if you can manage it. Will help obviously but want to discuss it a bit with Cel, PT and M1 first so we'll work on it tmwz.
