    Hi

    i have recently use moneyclaim on line to recover an unpaid invoice.

    i made a claim that did not get defended & after the required time I requested& was granted judgement. I requested immediate payment on this.

    How long do I have to for payment before I can request a warrant of control ?

    Technically you don't have to wait at all. Broadly speaking how much was Judgment for and the date it was awarded? Are you sure the Defendant can either pay or have assets that could be seized that are free of finance? Just because you have Judgment is no guarantee of payment and remember you also have to pay for the costs of enforcement first.

      Hi

      ive got two for separate people

      1st is for unpaid invoice of £70 judgement 27 sept

      2nd is for £165 judgement 4th October

        I appreciate I will have to pay to instigate the warrant / bailiffs but that cost just gets added onto their debt as gas already happened with the court fees

          I would be tempted to see what they do first as they may not have heard anything from the Court yet. Enforcement is going to cost at least £100, don' forget they could submit an application to Suspend the Warrant and make a payment proposal so think I would hold off for now, a lot may depend on their own circumstances and you could end up paying out more money for little return.

            Both people own their own homes, cars & are employed.
            i have received the confirmation paperwork from the court, so they should have.

            the system states that the issuing of a warrant costs £70

                  Yes and to be sucessful they would have to show good grounds as to why it should be.

                  Acknowledge Claim - within 14 days from Service

                  Defend Claim - within 28 days from Service (IF you acknowledged in time)

                  If you fail to Acknowledge the claim you may have a default judgment awarded against you, likewise, if you fail to enter your defence within 28 days from Service.
