    Well... entirely up to you - downside of not settling now is there will be about £75 added ( £25 court fee £50 sols costs) added IF Moriarty do issue the claim but of course that's only payable if you lost.

      Yes there is that. So, sorry for more questions. They have stated that the account is on hold, but have said they could issue a claim. If they issued the claim whilst the account is on hold or prior to receiving any documents, is that allowed? Just looking at my options really. As you say I can defend it, but not sure what my defensive would be. I assume the anomalies with who the debt is with would be my defensive. Then if I lost I would either have to pay the full amount within 1 month to stop a CCJ being registered against me, which is a definite no go obviously. Or do I make an offer direct to SLL now?

        Ok, if it were me I'd probably just try settle direct with SLL for a discount now because there's bigger things to be dealing with and a court claim takes time, stress etc to deal with and even though I'm pretty sure I could win the case, I think for the amount it'd cost to settle I'd rather do that and concentrate on other things. If it were say £1k then I'd probably stick with defending it.... but when it comes to it I know I'd be arguing on technicalities and fairness because I was a bit of an idiot to have borrowed from the lowlifes to begin with whatever the circumstances at the time, but I would make sure I could settle as soon as any judgment was awarded against me so my stubbornness didn't cock up the chance of buying a house for the next 6 years.

          Yes, totally agree. I have spent the last five to six years clearing my credit report up nicely and this would blow everything back out of the water for me, so definitely think settlement know is the route. I will send them an offer in full and final settlement. Is it worth trying the £50 offer that I sent Moriarty?

            That's not meant to be offensive btw just how I'd look at it ( and have done with a few of my debts I've settled in the last couple years so I could get my mortgage sorted ( currently have a full offer and waiting for exchange )

              I reckon start at 50% and expect to settle around 70%.

                Oh god, none taken. It was too the point and in this situation the only way to be. Yes, I wasn’t in a good place when I took the loan out and used it for selfless reasons but it now has the potential to bite me in the bum so need to eradicate sharpish.
