  • deadline for submitting evidence in a possession hearing

    I am going to court for a possession hearing and I feel like I need to submit evidence but there is quite a lot to write and compile. What I want to know is that how long before the court date can I submit evidence? The date is on the 30th of October. The possession hearing is for a business property I am renting which is still in a contract.

    There should have been an order made setting the hearing date, which should have included directions for submitting Witness Statements. Usually it is 14 days prior to the hearing sate to be filed with the court and served on all other parties.

      On what grounds are the repossesing ? Do you have a defence to be able to dispute these grounds

        It said about replying for the defence we have 14 days which I did on time but didn't submit a witness statement and my defence as my the solicitor who helped me draft the defence and a barrister who he works with (paid) told me I shouldn't as I will be able to do so in the actual hearing but now I have a feeling that I should send it in but I am not sure how long I have to submit further evidence.

        basically they were claiming a number of breaches. some we have "fixed" but have not accepted them as being in breach and others they have backtracked. They are mainly now going on that we can't maintain operating this way and about the character of a director. We believe we have sufficient evidence to defend their allegations in the form of images captured on phones and cctv footage as well as character statements.

        Acknowledge Claim - within 14 days from Service

        Defend Claim - within 28 days from Service (IF you acknowledged in time)

        If you fail to Acknowledge the claim you may have a default judgment awarded against you, likewise, if you fail to enter your defence within 28 days from Service.
