    Hello Guys ,
    Some Advice needed please
    I've received a Northampton County Court form for lowell solicitors for £290
    I've completed the MCOL acknowledgement of service for a full defense which bought me the 28 days from the date of service.
    Ideally id just like to pay the amount owed off in full without Court.
    My 28 days to submit a defense is up in 5 days but i can't pay in full till 8 days.

    Whats the best way of dealing with this?
    Contact Lowell solicitors to advise i can pay in full in 8 days? I dont know what to do with this MCOL now the acknowledgement of service is now expiring.
    i dont want a CCJ to be issued to me by default.

    Any help appreciated.

    You have 33 days from the date of issue to file a defence (28 days plus 5 days for service of the claim form), so you need to file a defence in 10 days not 5.

    If you wish to settle write to Lowell heading the email or letter "Without Prejudice" and make them an offer, start at about 30% of the debt and they'll probably work you up to around 50% of it.

    They have paid about 1p in the pound for the debt, so about £2.90 and £87 (30%) or £145 (50%) represents a good profit for them.

    Do not admit the debt, simply say that you are unsure if the "alleged debt" (use that term) is yours, but you are a busy person and to save the time along with expense of court you'd rather just settle this, so we can all get on with our lives.

    State to them: "If this offer is acceptable to you please confirm this will represent Full and Final Settlement of this matter, that you will file a Notice of discontinuance with the court and how I should make payment on X"

    X being 8 date time when you can pay them.
