Hi I need some advice urgently please. I received a court date for the 14th April. But the letter states if the court fee of £25 is not paid to the court by the 15th March then the court will strike the case out. I rang the court on the 15th March and the fee had not been paid. Yesterday I received Moriarty Law defence dated 28th March. Why has this not been struck out as this is after the 15th March ?

I am guessing when you say you have received ML defence , do you mean their Witness Statement?
You phoned the court on the 15th - firstly it may have been paid on that date and taken a day or so to update the system , secondly, Judges do not always stick to timescales if the fee was only a day or two late.
I would call the court again and check
Did the order that said the fees have to be paid mention anything about the WS- it is usually 14 days before the court hearing they have to be exchanged. If you have not sent yours, you need to get it done asap and hope the court accepts it

Acknowledge Claim - within 14 days from Service
Defend Claim - within 28 days from Service (IF you acknowledged in time)
If you fail to Acknowledge the claim you may have a default judgment awarded against you, likewise, if you fail to enter your defence within 28 days from Service.
