  • Asset/lending stream ccj claim form received, Help needed please and thankyou x

    Hi
wondering if people could help me through the process with this please?
Received a claim form from county court business centre from asset collections & investigations limited. Dated 02/02/2018
    Particulars of claim read
asset collections and investigation claim this amount in respect of an unpaid loan funded by The lending stream.
The defendant failed to abide by the terms of the contract.
Asset collections and investigation purchased this debt from the lending stream and subsequently sent a notice of assignment to the defendant to advise.
The defendant has either failed to respond to the claimant or maintain a regular payment arrangement, thus denying the claimant any opportunity in assisting the defendant in attempting to bring the matter to an amicable conclusion.
The claimant claims interest under section 69 of the county courts act 1984 at the rate of 8% a year from 11/08/2017 to 01/02/2018 on £600 and also interest at the same rate up to the date of judgment or earlier payment at a daily rate of £0.13.

after burying my head in sand timevto get sorted can anyone advise as what I need to do next got as far as acknowledged service on MCOL on 17/02/2018
Forgive me for being a bit dumb just found this site and not even sure if I'm posting where I should ect. I am searchin around on this site but am getting a tad confused.

Yes use the court claim number if there is no reference, and Asset seem to represent themselves - Was it C McGinley litigation executive signed the claim form? If no address for documents then use the claimants address

Do you recognise the debt / know what it was for, how much, when it was etc ?

Hi yes C.Mcginley signed, yes had rolling loans with lending stream previously (2015) got into ££ difficulties which I had notified them of at time unsure of what the correct amount should be though as just found default notice from lending stream for £384.60 which includes default interest and charges so unsure where £600 + has come from

I would also, as well as your CPR and CCA requests, send a SAR Subject Access Request Letter to Lending Stream to get full details of where the balance has come from. With regards the rolling loan elements and financial difficulty, have you considered making an affordability complaint direct to Lending Stream and potentially through the Financial Ombudsman ? ( see Debt Camel excellent article https://debtcamel.co.uk/payday-loan-refunds/)
