  • Lowell court claim and Lloyd overdraft

    Good morning all.
    I have found this site really helpful in defending claims against DCA's in the past with some excellent knowledge but need some guidance in a court claim from Lowell especially as this is the first overdraft claim I am defending.
    Quick overview..
    Lloyds overdraft up to £3000 with charges and fees added in defaulted around 2013 but still adding interest and charges although I asked them to halt the interest.
    Sold to Lowell in 2015
    Had a few letters from Lowell so I sent them prove it letter and do not acknowledge debt
    Northampton court claim dated 5th Feb for the following :
    The poc is as follows :
    Author Document
    Debt assigned on 24/11/15 by Lloyds banking group PLC and the claimant claims
    1. 3595.98
    2.Statutory interest persuant to section 69 of the county courts act ( 1984) at a rate of 8% per annum from 24/11/2015 to 02/02/18
    287.68 and thereafter at a daily rate of 0.79 to date of judgement or sooner payment
    Ref ****************** ( their ref number here )

    I am going to defend and do the AOS today but was thinking of sending a CPR 31.14 request to the claimant so will this be relevant. I was also going to send a SAR request to claimant today by next day delivery
    I know the amount is increasing on a daily basis with Lowell adding interest so also looking at this route for excessive or unfair charges
    Any help on the above most appreciated...

        Wait for Diana M to respond, the statement that the debt was assigned might be enough to request the Notice and Deeds of Assignment. You have got plenty of time to send the request off, so see what the advice is first.
