    Well they only just got in before the six years didn't they.

    Your defence says "Instant Cash Loans Ltd t/a Payday UK"

    but the letter from BW says the lender was MEM and the agreement is MEM Consumer Finance Ltd
    The letter posted http://legalbeagles.info/forums/atta...5&d=1509457453 is Instant Cash Loans Ltd t/a Payday UK - as is the claim form, and that text message.

    Then the top of the agreement seems to include both MEM and PaydayUK ( any chance you can remove that bit of redacting over the PaydayUK bit ) so JUST your name and address is deleted ( can't read what it says around it )


    Hmmm https://www.paydayuk.co.uk/media/293...1-07.02.12.pdf says they are all affiliated companys, but seems the actual legal entity the loan was with is in a bit of a pickle. Companies house wise they all seem to be different legal entities.

    No idea if that's worth looking into further, could be me being a bit dense lol it just confuddled me reading back through the thread.

        Well from what I see
        No proof of assignment
        No Default notice
        No response to the cca request - the agreement came from bwlegal in response to your cpr31. 14 and not from prac in response to your cca request. Is that right?

          Yes bw legal responded to the cca request nothing of PRAC

                    SO MEdiation - this bit - http://legalbeagles.info/forums/atta...9&d=1515061736 - Far as I can see you still don't have notice of assignment (~ Dec 2016 ) to evidence that PRAC have any rights to claim the debt from you, nor any default notice - only a copy agreement - so you can tick no as there's still more info needed.

                    There's also the slight weirdness with which company exactly lent the money to you in the first place. Do you know exactly who you took the original loan out with ? Which website / phone number / shop ?

                    is the covered over bit your details ? ( seems odd to be inbetween MEM and Payday UK )

                    Also LOOK at that APR - even in payday loan world that is completely insane.

                      On their website ( PayDayUK) they've got this

                      Payday UK are no longer offering new loans through the website; www.paydayuk.co.uk or over the phone. We apologise for any inconvenience this may cause you.

                      The business has made the decision that when accounts reach a certain stage within the Collections journey, they may be sold to a third party company for collection. Going forwards, your account will be owned by PRAC Financial Limited and will be managed by BW Legal

                      What does this mean to me?

                      This means that your account is no longer owned by Instant Cash Loans Limited. All future contact will need to be directly with BW Legal.
                      doesn't absolve them of a formal notice of assignment though - but again, no mention of MEM.

                      In 2012 it looks like PayDayUK were on MEM Consumer Finance's FCA authorisation.

                      Then there's this - https://www.fca.org.uk/news/news-sto...ustomers-about - which says it was Dollar t/as Payday UK - which scans with this letter http://legalbeagles.info/forums/atta...5&d=1509457453 which says PAyday UKK at top, Dollar on the right, and Instant Cash at the bottom - no MEM mention.

                      Really you want to know if MEM were actually t/as PaydayUK on the date you took out the loan.

                        Dollar Financial is the US parent. It was an early big provider of payday loans in the UK, owning the Money Shop and Payday Express brands.

                        It acquired Month End Money (MEM), who traded as Payday UK, in February 2011.

                          Thanks DC, it's all a bit convuluted isn't it - do you know when Instant Cash Loans came into it ?

                          So the agreement could be correct as that was in 2012

                            Instant Cash Loans Ltd are the UK parent company and have been for a long while.

                            FWIW I suspect this is a complicated red herring for defending this claim.

                              Possibly, however the particulars of claim are for an agreement between Instant Cash Loans t/as Payday UK, and the agreement and other documents are for MEM t/as Payday UK and so far there are no notices of assignment between the companies or from anyone to PRAC.

                                Yes that is just my address covered. And the loan was with payday uk.
