Personally I would file this in the bin and not give it another thought. The arguments do not hold water.

The retailers investment in security equipment would have been the same irrespective of the actions of you sons friend, so there is no applicable loss in law.

The concept pf punishment for wrong doing is also misplaced, this would be a civil action punishment is a remedy reserved for the police in pursuit of a criminal action.

Intersting that they say that their client will not withdraw the claim, have you received any claim form the court in this matter, or is this just a little more poetic license.

I'd still ignore .... they are trying to scare your son's girlfriend into paying (possibly seeing her as the 'easy' option instead of your son?)

the value of the goods or cash allegedly stolen is relatively small – often just a few pounds. But letters from RLP and Drydens demand substantial sums as compensation for “the loss and damage caused by your wrongful actions” (RLP) or “the security costs incurred as a result of your actions” (Drydens), and threaten county court proceedings if prompt payment is not made. Some letters from RLP have also stated that “the personal information we hold [on you]” will “now be held on a national database of incidents of dishonesty”.

Thank you all again for your responses, I will relay them.
Both son and his girlfriend are concerned that the threat of database entries and sharing may affect their future references for employment/mortgage. Does this organisation have any legal entitlement to 'list' them in any way?

No. Neither RLP or their client has any legal entitlement to list a person's details on some "database of wrongdoing" and then dish out the information to their cronies. This smacks of the Economic League and, latterly, the Consulting Association. The latter took a hammering from the courts for operating an illegal database containing data that was inaccurate and intended to prevent people gaining employment. The Information Commissioner's Office (ICO) takes a serious view of such databases. The ICO has the power to fine offenders up to £500,000.

I'm starting to wonder the same thing ... if RLP are storing data (names/addresses etc...) they need to be registered as data handlers. I'm going to look into this, but I believe they might be on less than solid ground in that respect.
If neither your son or his girlfriend were charged by the police, they will not have a 'criminal record' that would jeopardise any future career.

One of the requirements of compliance with the Data Protection Act 1998 is that any data held must be accurate. There is also a prohibition against using data for an illegal or unlawful purpose.

Are you referring to the alleged 'blacklist of culprits'? It would be VERY interesting to see that, but I see no reason why the OP should waste £10 getting it given we all know it is unlawful, if it exists.

As regards other data, there's not a lot to store. They've stated there was no arrest etc... the individual's details are unlikely to be incorrect. I just don't see the point. £10 is a lot of money to some. If it's comfortably affordable and the OP wants to do us all a favour by buying LB acopy of the register, that would be great, beyond that I just don't see the point.
