        What's the date of the letter, I wonder if the sent it a bit earlier to avoid the strengthened rules on misleading and aggressive practices...... that's why its under the 14 days they gave in their last letter......

              First letter Dated: 21st August
              2nd : 2nd September
              3rd : 12th September
              4th : 26th September
              Various periods of response deadlines given, from 21 days to 14 days.
              Note that the letters were dated with these dates but received well after printed dates on the letter!

              Amethyst, they did respond to the SAR request: "...We therefore require your fee of £10. Upon receipt of your fee, we will respond to you within 40 days as the Act prescribes"

                It'd be interesting to follow the SAR up, if you can. But otherwise just file their letters away.

                    If RLP decide not to comply with the SAR, give the Information Commissioner's Office (ICO) a ring. I have found them to be very helpful where non-compliance with SARs is concerned. They also have the power to fine those who breach the Data Protection Act 1998 up to £500,000.

                      I feel the same, however the threats of being on the so called 'closed group for employee screening' etc, it would be interesting to have copies of those entries if they so exist.

                        I agree with Amethyst it would be good for LB to know what would be in the SAR for the 'closed group for employee screening', but agree with Des that I can see no sensible reason for wasting £10 on it. Would LB fund it for the OP as a one off perhpas? Just a thought, may not be possible.

                          RLP would be obliged to disclose what they had recorded on a data subject on that database. I do know the ICO is getting tough with those who feel compliance with the DPA is optional or doesn't apply to them. What ICO seem to be doing is giving those who make a genuine error in their SAR compliance clear advice as to their obligations, as long as it is the first time it has happened. However, if the non-compliance is deliberate and/or serious or a previous incident is on record, then the ICO will come down on them.

                              Latest Update:

                              Son's girlfriend received a letter responding to denial of liability. The deadline of 7 days to respond has passed.

                              The letter states that her response is a '...pro-forma, standard letter downloaded from the Internet. Sending such correspondence does not assist because it doesn't address the facts of this particular case.'

                              The letter continues to outline their version of events and then carries on in the vein of stating 'You may not have been charged or cautioned......You appear to accept no responsibility for your actions even though your wrongful conduct has caused considerable loss and disruption to our client's business. Had our client not invested heavily in security and other loss prevention measures you would have been successful in your attempt to price swap an item.'

                              The final paragraph then states:
                              'Our client wholly reserves its position in relation to this incident. Our client is not prepared to withdraw its claim. This matter will therefore proceed. Please can we hear from you in response to our letter of claim within the next seven days if Civil Court action is to be avoided.'

                              Son did not received the same letter.

                              Any comments on any response or otherwise?

                                Clearly this is blackmail (not unusual for them). A copy of said letter should be sent to the FCA as part of your compliant.
