  • County Court Breaching Data Protection ...Advice and Help

I have recently been informed that the local court has sent all my documents which include original ID, bank statements Marriage certificate origional form elsewhere, I am helping my partner divorce her ex husband who is in prison serving a 10 year term for assaults on her children, I will spare the details as you can imagine the nature, I sent the relevant forms in and obviously these included personal details regarding the divorce, along with ID, Marriage certificate, bank statements, a week later I received somebody elses paperwork, with all there ID etc,
I contacted this person as they were local thinking maybe they had received mine, however they had not, I gave him his paperwork and contacted the court, they have now sent a letter saying that it has been sent it to a solicitor who we believe is the ex husbands solicitor, we have spoke to him and he has said that he only represented him on a one off case so all paperwork regarding him would have been sent to the prison, now we are in a position where a dangerous offender potentially has our address details...its a clear breach of Data Protection but how do you go about taking action against the County Court? as I cant summons them as if the event was to be Heard at County Court. Our main concern is that we may have to move home as the ex partner will have our address...

That is very serious breach of data protection by the court. I'd give the ICO a call on 0303 123 1113 and tell them about the breach they may be able to suggest the best route of complaint.

Yeah I have spoken to them, they have advised me to write directly to the court manager, for them to address my concerns, which I intend to do this weekend, then I will forward a copy of that letter to the ICO, I have the letter admitting that they have lost the paper work, so thought I would get a bit of advice on here to help me word the letter to the court in a well structured legal manner, I have tried for over 2 months over the phone, the lady even tried to blame the solicitor, but my point was it should only have been sent to me.

The complaint would need to be in writing, the court service would have 21 days then to respond. I'm not sure what the remedy can be, it sounds as though due to the seriousness of the breach it could result in having to relocate.

The court service do have a formal complaints procedure which I think you should follow in the first instance and cc everything to the ICO.

Thanks for that, it would seem that the Courts have overlooked this EX343, and I must have spoke to them 10 Times, I will address them this weekend with the form and a letter, and will see what there reply is, I will keep it posted on here, great site, amazing how much knowledge is here.

I have just spoke to the Manager of the Court before I do this form, they have now confirmed that they have spoke to the Solicitor and he doesn't have any idea where the papers are and cant say what his office staff may or may not have done with them, again they seem to be placing blame on the Solicitor not returning them, but as I explained it was there initial fault so I will go down the EX343 Route for now
