    2 years (minimum) from date of delivery, 5 years in Scotland and 6 years in the rest of the UK

      Secondly, in the letter reply on page 1, the CS agent claims that because I don't have the phone, I can't claim. Seems a bit of an odd sentence for them to write.

        It would appear to me that, having supplied a replacement 'phone, Apple has fulfilled it's obligation as per UK's SOGA.

        There is no obligation to refund just because you have changed your mind. (Although, if you were wanting to upgrade/change to another Apple model, they might be amenable)

        You should, however, be refunded the £120 + VAT which, in my opinion, was charged erroneously.

        For avoidance of doubt, could you please let us know whether the region of Canada where you bought the item falls under Canadian/English law or Canadian/French law (ie Quebec) - all I get from your link on post #1 is an error message.

          It was bought in Quebec although the law should be the same/interchangeable (AFAIK).
          The £120 is their standard charge - they said it was not a product fault and could not therefore be covered under consumer law. I did ask for a free replacement as it was likely a product fault but they said no.
          The letter they wrote tries to claim a similar thing even though what a customer service/"genius" in the store says is probably just what he's been told to say...same as the CS representative.
          I just retried all the links in post #1 and the attachment and they seem to work. I can PM them if not?

            Quebec is predominately french law.

              I wrote another letter with all the points mentioned and I received this:
              Dear Mr. xxxxx,
              Thank you for your email to Mark Rogers at Apple. Your correspondence concerns an issue that we feel would be best handled in a phone conversation.
              Unfortunately, I have not been able to reach you on the phone. You can contact me at 00800-2775 2775 ext xxxxx, Monday through Friday, between 8.30 a.m. and 5.00 p.m. GMT time, or you may send me an email including an alternative telephone number and a preferred time of contact.
              I look forward to hearing from you.


              I then said "I request you to reply by letter because I do not want to discuss on the phone..." and received this:
              Hello Mr. xxxxx,Thank you for your email. I believe Apple have responded to you previously in letter format, with regard to this matter. I am very happy to discuss this matter with you by telephone and I invite you to call me to discuss further. Alternatively if you want to provide me with your preferred time and date of contact, I can call you also.
              I look forward to your response.

                If you phone them, make sure you record the conversation - most mobiles have recording facilities nowadays. :beagle:

                  After tlaking with Apple Customer Care, they refuse to admit any fault.
                  Do I take them to small claims court? No doubt they wouldn;t bother to turn up and I would win by default.
