    Ok, in answer to Execs question I don't know about counter claiming I mean is he even paying up people their bog standard court costs? And what is happening with Ethans counter claim that he won?

      Yes he is paying the costs ( well has to date ) except for Ethan's - Richard H. has taken it upon himself to appeal the judgment and submitted a rather dire effort at an appeal to the court. We're currently waiting to hear back from the court to see if it will go anywhere at all.

          Only flutterby ( hearing 21st August ) - not really sure where things are at with it, still waiting to see what's happening with Ethan's case really.

                    The cases we have submitted it in previously haven't actually needed the skeleton as the Judge has basically chucked the case out on the witness statement. Your witness statement is pretty strong so I really don't think you need it. http://www.legalbeagles.info/forums/...977#post548977 is Karen's skeleton.

                    The only think we might want to do is get a copy of the new ASA adjudication in - ref your WS para 46.

                      Where will I find a copy of the new ASA adjudication and do I take it on the day or drop it off before ? Sorry I am really struggling to think straight right now as something a lot more serious has hit me this week and not sure I can go through with going into court next week. My nerves are in shreds.

                        Hi Mand, Sorry to hear you are struggling with things xxx You could notify the court that you will be unable to attend and ask them to hear the case in your absence. Of course that is a little bit risky but we can still go with sending in skeleton arguments tomorrow, with the ASA adjudication attached ( https://www.asa.org.uk/Rulings/Adjud...x#.VboMa_nAle0 ), along side your request for the hearing to be heard in your absence and explaining the circumstances. You are meant to give seven days notice. maybe give the court a call today and ask them if the case is going ahead and if they have heard from the claimant - explain your circumstances and see what they recommend doing.

                        Otherwise if you go, then take the ASA update with you.

                          I am going to go so what if I break down in tears this is the impact he has had on me. I rang the court this morning and he hasn't sent any message that he will not attend and has paid the hearing fee. So I just print off tha ASA Adjudication but how do I explain it in laymans terms if I have to? Do I give it to the judge or wait to be asked for any new findings. Thanks in advance

                            In laymans terms, the ASA found his website, and others like it, misleading...easy as that

                              Good to hear you are going to go, really it won't be a quarter as bad as you think it will be xxx Most people have been in and out in five minutes. It is unlikely you will need the ASA ruling but best to have it just in case. Take a copy of the witness statement with you as well then if you are asked anything you can look at it. The guys that have been in since, pretty much since Alex Yates in Cambridge, haven't had to say anything, you go in, the judge will look through the papers and possibly ask you a couple questions off your witness statement - nothing to trip you up, and mostly it sounds like they are rhetorical anyway, then she/he will say (most likely) that they will dismiss the case.... that's your cue to ask if you could ask for costs for the day ( as had to have time off work/get childminder/park etc).

                              I am extremely shy and anxious in these kind of situations, I went to a charging order hearing on my old house, I was absolutely sh*tting it before I went in, and almost left a couple times before they called me.... but they really do make you at ease and it isn't half as bad as you think it will be. I think I managed to utter about three words, Good Morning, Thank you, Bye... lol. That's why it's a good idea to stick everything you can in your witness statement, the judge knows the whole case before you go in xxx

                                Amethyst Help panicking... I can't find any of the exhibits I made copies of do I need to take copies of all the exhibits incase the judge refers to them? I have a copy of my defence and witness statement but can't locate the exhibits. Maybe I didn't make copies for myself i simply don't remember. I know I did copies for dickhead and the court and ran out of ink then went out to purchase more ink so don't think I did a third copies as there was loads for myself. Is it adviseable to take copies of exhibits as I'll have to start from scratch recounting them all at this late hour. Thanks
