    Thanks, i'll give the court a call in the morning, I was going to take the witness statement down after work tomorrow so not to pay for postage, i'll ask if I can send it by e-mail, thanks x

      HI
      Phoned the court up today and the address they have for R Howard is 12 Deer Park, so she told me to send it there, will be sending on Wednesday so he gets it on Thursday.
      Took my witness statement to the court this afternoon.
      So I should receive his witness statement on Thursday then? Lets see if it arrives.

          If Thursday is the filing date you should but he has been known to wait beyond the filing date so that he can counter points made in the defendant's WS. Unfortunately the courts often accept the claimant's WS if it's filed a day or two late.

          If that happens and if needs be we can then file a skeleton argument to counter his WS.

            The 5th June is a Friday so I should be sending it on Thursday to get there this Friday? So I should receive his on Friday? If I don't get it until Monday or Tuesday that would be three or four days late, surely the court wouldn't accept that?
            Anyone else in court soon?

              You should get his on Friday, you can ask for his witness statement to be inadmissable if it is late, but realistically in small claims it's not very strictly stuck to and its not worth applications to strike out etc.

              We have a hearing on the 26th May (AvidUser) but the defendant can't attend so will be heard on paper and the judgment won't be known for a few days after... then another on the 1st June (which should actually be quite interesting as it includes a counterclaim for harrassment and breaches of the data protection act - (tyke1601)) We'll of course update the forum soon as we have any news on either.

                Looks like his statement is at my delivery office, so he sent it in time, can't wait to read it. A person from Trading Standards phoned me the other day, i've sent him my statement just got to scan the exhibits to send him.
                I'll let you know what he's put in his statement.

                    Thanks for sending all that over Karen [MENTION=62194]Magoo[/MENTION]

                    We will need to do a skeleton argument to bring some order to the arguments for you and the judge at the hearing, answering some of the points made in the Witness Statement.

                    I'm working on this now and we should aim to send it to the court and Richard the day before the hearing (so to arrive on 4th June), will send over a draft soon as I've done.

                          lol, just amusing myself with the skeleton argument....

                          35. The list of ‘Overdue Invoice Charges’ do not appear to relate to any reality whatsoever. Calls, emails, texts etc were not received at the times or dates stated as evidence by the Claimant in his own witness Statement at Exhibit E demonstrates. The Claimant claims to have telephoned the Defendant, sent a SMS text message, made a ‘VB Call’, sent an Email AND posted a letter all at 2.10pm on 13th February. Apart from the fact the rest of the Claimant’s exhibits show only a text message was sent the Claimant would have to be a (woman) very talented individual to multitask in such a way.


                          Possibly will want rewording.... maybe.....
