      As Kati says, if you can email me a copy of the court claim form you have received that would be marvellous and I'll set you up a thread where we can go through everything.

      Your first step is to register and log in on Moneyclaim online https://www.moneyclaim.gov.uk/web/mcol/welcome and ACKNOWLEDGE the claim - ticking intend to defend in full.

      This will extend the time you have to respond to 28 days from service.

              Hi - many thanks for your prompt response . Its nice to know someone is looking at it ! I think you already have a copy now of the County Court Claim Form ? I will register my intention to defend . Please let me know what I need to do next. I did see that someone from Legal Beagles was hoping to get an opinion on the prospects of defending these actions in general - is there any news ?

                  I understand that ASA is considering the appeal by British Passport Services. I wonder if the ASA is aware that British Passport Services are continuing to trick large number of people into believing they are an " official " site - you only need to look at the blog on Which to see new names appearing every week . So the website is clearly still misleading and BPS have not taken action to make clear what their so called " services " actually consist of. Is it possible to make ASA aware of this ?
                  Another factor that I struggle to understand - BPS are able to make block bookings at the Passport Office ( presumably in fictitious names ) and then tell people to use this name when they turn up for their appointment. I cannot understand why the Passport Office allow this - if they stopped this practice it would surely make it more difficult for BPS to trick people. My wife recently had to drive from the south of England to Durham Passport Office as this was the only Passport office that could give her an appointment . Wonder if BPS - and other copycat companies - are blocking up the system with false names creating difficulties for genuine customers.

                    We're working with ASA, they know all about the current situation.

                    In regards to the dishonest statements on the BPS sites that they have been given the all clear by ASA, the ASA have provided this statement for our members to produce to the court:

                    The 17 September adjudication still stands (despite the fact it is
                    currently subject to the Independent Review process) and, as set out
                    in that adjudication, the ASA Council found the advertising to be
                    misleading and in breach of the CAP Code. Any statement that the
                    adjudication does not stand at the current time would be inaccurate.

                    The case is currently subject to the Independent Review process and we
                    are hopeful that will be completed in March, at which point any
                    amended adjudication would be published on our website. We are not
                    able to give further details of the case as it is ongoing but the fact
                    it is subject to Independent Review does not mean that the
                    adjudication will (or will not be) changed either in wording or
                    overall decision. Any suggestion that a final decision has been made
                    by the ASA Council in the case as a result of the Independent Review
                    would be inaccurate.

                      Again, we've alerted HMPO that in some BPS T&Cs they actually require the customer to lie to the HMPO receptionist about their identity. Unfortunately they have a policy that anyone can book an appointment for anyone else.

                        Mmmmm to return to the point of charges associated with a contract being in default actually being justifiable.....
                        According to the log of charges Amethyst posted, on the 12th February 2015 at 2:43 pm Sam Harris NOT ONLY managed a telephone call, no... only one action at a given time for this man????? Nope... He ALSO managed an email.... NOT CONTENT with performing 2 actions at that precise moment, wait for it..... He sent a text.... While all of the above was going on, at exactly the same moment, this human swiss army knife managed to type out a letter, which might explain why any letter generated was a load of shite, probably done by his arse.... Which really beggars the question, if all these were performed on the same date and time by the same man then seeing as how he couldn't, wouldn't that make these so called charges, itemised hokum?????? I would look at all his other 'so called' logs of extra's may well find their respective chronologies make the charges suspect....:tongue2:

                          Actually [MENTION=62109]mike2015[/MENTION] can you have look through your call records and emails / texts and cross match with the charges list


                          Once you've put your acknowledgment in can you download it from MCOL and send it me pls just so I can keep track where we are

                          And can you give a little description of how you came to be on the BPS site, what you did, if you tried to cancel, if you went through the payment process - just so we can start on a witness statement to help ensuring your defence is as good as it can be.

                            Good morning ,
                            Thanks for the last message . I have registered my intention to defend the claim - I will send you the confirmation to admin@legalbeagles.info . I cannot see the call record charges at the moment - I guess this was probably sent to me by British Passport Services ? Or can it be found on the Court's site ?
                            I will also give you a history of events .
                            I'm curious to know - I think you mentioned that so far this company have only obtained money by default ie people giving up the hassle and just paying them on receipt of Court papers ? So nobody has yet defended it in Court ? Will it be possible for the Court to know the scale of the grief this company is causing - so many people being harassed for a service they didn't actually receive ? Or can the Court only consider each case on its merits ?

                              Call charges are on my previous post - there is also a link to it ( BREAKDOWN OF CHARGES ) off your signedcontract.org.uk page.

                              Just see if you can cross check those with your phone records. one on 20 dec then 3 calls on 12 feb.

                              The court will only look at each case on its merits but we're pushing the point that it affects a lot of people in the first case.

                              People may have successfully defended these claims but unfortunately haven't reported it on forums/t'internet - if defendant wins there's not a CCJ against the claimant so there's no record publicly. There is one case listed by BPS which is a guy who defended then didn't respond to the court with his directions questionnaire, so it got judgment due to that rather than on any case merits.
