    So if I only do overtime occasionally I can count that for example since January I have equated 19 hours n will be doing another 8 next Monday does that count

    I do 52 hours overtime a year anything over that I'd get paid for

      If you do 52 hrs overtime a year - that's an hour a week - I reckon you just need to decide you work 24 hrs a week as per your contract and pay slip and stop worrying. Anything over 24 hrs you get paid overtime for. So seriously you have nothing whatsoever to worry about.

        You get paid for 24 hours, you do overtime but have to work 52 hours overtime with no extra pay to cover the extra hour?
        Any overtime over that you get paid for and will also be added to your hours?
        If that is the case then you work 24 hrs per week get paid for 24 hrs per week and that is what is need for you to be able to claim Tax Credits as far as I can see you do not have a problem.

          Yes that's right I work 52 hours overtime unpaid then when I do overtime other than that I am paid for

            Well pardon me if this seems a silly question but you work 23 hours and 1 hour overtime unpaid, but you get paid for 24 hours?
            so you actually do not do 52 hours unpaid overtime you are actually being paid for it

              You should probably just stop listening to your friend. You work 24 hrs, you are paid for 24 hrs, you are contracted for 24 hrs, there is no issue.

              Sometimes you do overtime and get paid for it. Excellent.

                I did the same when I worked in the pub ... because it was mainly seasonal, my hours were averaged out over the year (it made it easier for me AND my boss :nod
                Debt is like any other trap, easy enough to get into, but hard enough to get out of.

                  I have just spoken to my employer after telling them how worried I am having these variable overtime hours and they are going to give me a guaranteed 4 hours overtime a month on one day and give me a week notice as to what day they will need me on.big weight now lifted off my shoulders

                    Well I'm back to square one of worrying I also posted this question on another site I have been accused of tax credit fraud n that if I got compliance checked I wo be in trouble does anyone definitely know if it's permissible to average hours for tax credits

                      Some people work different hours each week. If there is a pattern to the work, for example a person works 14 hours one week and 18 the next, there is a two week cycle and the person can look at their average across that cycle. In this example the normal working hours would be 16.
                      I'd still say you are OK averaging out your hours

                        I'm so confused I put this on the moneysavingexpert.com forum not 1 person as said I can do this I have been slated and accused of all sorts I asked tax credits helpline about working 23 23 23 and a week of 27 they have told me I can average this to 24 people on the other forum have told me they hope I got the name of the advisor that told me this as its wrong so I'm even more confused now

                          If you have been told by an advisor on the tax credits helpline that you can average it out, then that is what you CAN do I'm not well versed on the layout/workings of other forums, but (IMO) they were being a bit harsh

                          You work 24 hours. It's in your contract as 24hrs, you do overtime to ensure it's 24hrs.

                          Personally I would stop worrying about it :nod:

                              Some people on MSE aren't exactly known for checking their facts and being non-judgmental I'm afraid. You have it from the horses mouth, the tax credits helpline.

                              You are doing 1 hour of what you call overtime every week.... HMRC call it working hours - your contract is for 24 hours, you are paid for 24 hours and you work 24 hours, there is seriously no problem.

                              SO if this is going to drive you batty, which it really shouldn't do, what would happen if you did have your contract changed to 23 hours and only worked 23 hours - what tax credits/benefits would you be entitled to in that case?

                                I wouldn't be entitled at all I have now changed my hours to three weeks of working 23 hours and one week of working 27 but still been paid at 24 each week
