    I am writing to you regarding an attachment of earnings order sent to my employer today i myself recieved a copy and am lets say very unhappy about this.......since 2007 i have been recieving letters informing me that i owe the DWP 379 pounds for a social fund loan taken out in 1999.

    I wrote back denying knowing anything of this and that i had never taken out a loan. The letters continued every know and then and i would write back each time or call them.

    I have asked for further information, when where and so on and for some kind of proof that i did indeed take out a loan with them. I have never been given this information, and have been told they do not keep signatures and such for this amount of time.

    I am told that aaaaaaaaaaa signed for the loan when infact i wasnt aaaaaaaaaaaa until i married the following year. I have been told the loan was taken out in Ireland, i have been told the loan was taken at Harrow, letters come from different departments every time. Still i have no proof sent to me of any kind.

    I today again have spoken to debt management and the social fund call centre, who advised could i get bank statements from 1999. No i cant i am with a different bank now and the bank i was with is no longer.

    They ask this as in the year i was suppose to have had a social fund loan I had only just moved to this address and had infact made a profit of thousands of pounds on the sale of my previous house which was in my bank.

    I could use some advise on what to do as all correspondence from me have been ignored. I am waiting for a call back and have been advised i am entitled to proof but as of now my salary will be deducted with this amount.

    I had no warning of this, no right to reply, but have the proof of my asking for proof from them.

    I would suggest a Subject Access Request made under the Data Protection Act 1998, to require the DWP to provide all the personal data it hold in your name and specifically the acceptance form/letter which has to be signed before any funds are released.
    The power to obtain Attachments of Earnings orders was set out in the Welfare Reform Act 2012 along with the power to pursue debts however old they may be.

    The DWP does not require the fee of £10 for the SAR to be paid.

    Initially send the SAR to DWP Debt Management it seems to get a better response as the request gets to the right people more quickly.
    Basically the department has no obligation to inform that an order will be made.
    Your employer cannot refuse to comply with the order.

    Ultimately you can ask your MP to take the matter up with the department, this way the complaint gets answered my a minister in the case Lord David Freud the Minister for Welfare Reform.
