  • PPI Succesful What Now?

    Hi there last year i toke up an offer from a claims company to have a look for me into ppi (believing i had very little if any) turns out Clydesdale Bank sent me a letter saying i was due £5844 yeah.
    So in this letter from Clydesdale it made the above offer and stated that the amount would not be disclosed to my claim company as they didnt beleive they had the authority to do so and this was my last letter/offer and i gladly accepted it and sent them the form.
    So far i have heard nothing from my claims company bar a statement in December saying they are still looking into things, so the big question is do i have to pay them can they find out the amount i was awarded how will this work if its my word on the actual figure i got bearing in mind ive had no contact and the money will be here tomorrow.

    Well that's a nice bonus for you on the PPI refund, well done.

    Legally, you have signed a contract and agreed to pay the claims firm a certain % of your refund. Interesting that Clydesdale have stated they won't disclose the figure to the claims firm, have they said whether oe not they will inform the CMC the claim has been settled ?

    Could you say who the CMC are so I can check out their terms and current status.

      You might be able to argue that if Clydesdale didn't accept the CMC's authority to represent you the CMC were incapable of providing you the service you contracted them to supply.

        Mcginness Associates is the firm and the letter from bank did not say about informing them it had been settled only that accepting the offer would close and settle the case.

          They don't shed much light on things. You should have signed a letter of authority with them, can you post it up removing any personal information?

            Hello. I'm in same situation with McGinness right now !! Got money in October (£11k) and had the letter saying bank hadn't advised CMC and thought I'd got away with it. Turns out they do know and I got a letter from Hannah's Sheriff officers today saying I'm breaking the agreement signed by McGinness for avoiding contact, and that they ARE aware about the money and I've to respond within 14 days or they will take me to court.

            What do I do? What are you going to do, Joeellen? I need some advice.

                  Can't find letter from the bank but this was sent 27th June from Clydesdale -'I refer to recent correspondence which has been passed to us for investigation.I am sorry to learn that you are dissatisfied with the service we have provided. We take all complaints from ourcustomers very seriously and are constantly striving to improve our level of customer service.We regret that the Bank is unable to keep the Third Party acting on your behalf, updated with the progress of yourcomplaint as the Bank' and I'm positive the letter of award I got said something similar.

                  I got a call from the CMC last week and they asked if I'd had anything from Clydesdale. I said I hadn't and I asked them to stop doing my claims. Then yesterday I got a letter I had to sign for from a company called Hannahs and it says- 'Notice of Legal Action. We intend to instruct our solicitors to commence action against you for recovery of our fee should you not contact us within the next 14 days offering acceptable method of payment'. The amount of money isn't specified but I'm worried that they know how much I've got and if I get in touch and pretend I don't have the money that it will count against me.

                  really worried about this because I have used that money up on other debts and can't pay the fees if they are asking for them.

                    If you have had the Money as a result of their work you if the contract is legal owe them their percentage you need to post up the contract you SIGNED soother Beagles can advise.

                      On this are you sure they're asking you for their cut of your PPI refund or a cancellation fee? Do you know how much they are demanding?

                        I don't think I kept the contract. I signed up a year ago and wasn't expecting it to go anywhere. Sorry.

                        No money is specified on the Hannah's letter, just that I have 14 days to get in touch. I don't know what for but I do know what for - if you know what I mean? If there is no way around it, I'm going to have to come clean and pay what I can.

                          I think that you need to establish with Hannah's how much and what for and let us know.

                            even state she requested you to contact her and ask the reason! if they state the contract and they know you have refund then come to some agreement, or even , they hope you do not cancel etc find out reason 1st,

                            did this with another firm few years ago had to pay them in installments but they stated missed payments yet sent to their pay office signed for and they refused to believe so stopped payments & they sent threats, then they were put out of business by the regulator. (Ashworth Law) so called conners.
