  • Do I believe them?

    Hi everyone.

i contacted Lloyds bank in December as someone told me that you could reclaim ppi on mortgages (I did look a few years ago and read that you couldn't)

I took the mortgage out in 1997 and paid it off in 2004. I was definately mis sold the ppi as it wouldn't cover me for redundancy as I had 2 jobs, and I was fully paid for 24 months in the event of sickness. I explained this at the time but was told it was a condition of the mortgage.

lloyds have now rejected my claim as they say they have no record of the mortgage, but that i must now send them £10 to their archive department who will look to see if they can find a record of it. Is this normal? Is it worth sending the £10 as surely if they have no record, then they have no record? Has anyone else been in this position?

if a bank rejects the claim...is it worth pushing it?

    thanks

Did you not send them a Subject Access Request before contacting them? If not, then the bank are correct unless you have documentation specifically relating to the PPI on the mortgage.....

Subject Access Request (SAR) made under the Data Protection Act 1998, £10 statutory fee payable (use cheque or postal order clearly endorsed " For Statutory Fee Only" keep a copy)
The Letter should be addressed to The Data Controller of the bank: Use signed for post check delivery.

The bank has 40 calendar days to supply all " Personal Data " held on you.

Having stated in post 2 that they can ask for the fee, i should have asked whether you filled in their PPI questionnaire?

If you did then there maybe an issue locating the paperwork if your address was different now than when the original PPI was taken out.....

Yes david, I submitted the claim....of course address is different but also it was in my maiden name, have sent off my £10 so will have to wait and see now. Maybe it's just me but I did wonder if they didn't look very hard, all the info was sent in lol

My name's not David, btw. Only reason I asked was because I was wondering why they were asking for a SAR to be done if they had all the information plus if you've sent £10 then they are searching with the same information which they supposedly came up with nothing previously, which makes no sense to me. From post one you have a clear recollection of the discussion so I guess the next thing I would advise you to do whilst they are looking for it is to try and recall any other aspects of their PPI where you were already double covered, one aspect being death in service benefit(maybe one or both of the jobs had this benefit(s) which means you were triple covered).

That sort of stuff. I think the PPI questionnaire linked above goes through this scenario. Lloyds are one of those banks who have got away with paying out less than the value of the PPI based on the fact that whilst it might have been sold incorrectly, that a protection product was suitable for the person buying the product. Am trying to cover all bases so that there is no surprises for you.

Oh sorry, my mistake. Will wait now and see what they turn up. I think they were trying to tell me they cannot find any trace on their system, but that the information will be in the archives, which is what I am assuming is going to happen next. Will keep you informed. Am going to push as far as I can :-)
