      Seems similar to Sapph's storecard one, I think. Will have to scrutinise the "agreement". Its only one sheet and not a good copy.

        It's headed up "10 Minute Application Form". Its a very bad photocopy and not easy to read. They have thoughtfully highlighted the bit where OH has ticked the box. I'll bring try and scan it in later at home, or bring it in to work tomorrow and do it. And i'll post up the wording of the accompanying letter. Eventually.

          In the meantime......

          I have now had a reply to my Prelim from Crap One. Basically - Sod off, you applied on the internet, we sent you the form, you ticked the box, so tough.
          But I'm sure they sent me my alleged CCA (it was really an application form I think) last year. I'll dig it out and see what it says. If OH hasn't chucked it away in one of his mad sorting out sprees.

          More will follow.

                This is my initial draft of reply to capital One.

                Any editing/suggestions would be welcome.

                Repayment of Payment Protection Insurance

                ACCOUNT NUMBER: xxxx xxxx xxxx xxxx

                Thank you for your letter of 29th February, the contents of which are noted.


                Frankly, I am disappointed that you are not prepared to accept responsibility for the mis-selling of the PPI on the above account and would emphasise the following facts for you to consider:

                1. I have no recollection of receiving any documentation from yourselves in relation to PPI and the fact that it was optional, nor of ticking the box to request PPI.

                2. As stated in my previous letter, my employer provided a generous illness and redundancy package, so I would have had no need for PPI.

                3. Insurers are under an obligation to ensure that the policy they are selling is appropriate to that customer and clearly, you have not fulfilled this requirement. Furthermore, you state in your letter that “Capital One is not authorised to provide advice in relation to insurance products”. Therefore I would contend that you should not, in that case, have sold the PPI at all.

                4. It is the responsibility of Capital One to make sure the insurance sold is fit for the customer’s situation. You should also be aware that according to the Misrepresentation Act 1967 the onus is upon Capital One to prove that PPI was not mis-sold.

                I read with interest a press report recently that the Financial Ombudsman Service says it received 1,499 complaints about payment protection insurance in January alone. This compares with 1,832 for the whole of the 2006/07 financial year. The Ombudsman also reported that 80% of the PPI complaints it received from customers were being upheld.

                Accordingly I would suggest that you repay the money taken from me in full and without delay.

                I require a full refund of all my insurance payments, plus interest, totalling £455.11.

                As my account is now closed, please send repayment to myself in the form of a cheque, at the above address.

                          It is a bad copy of the agreement isnt it.

                          So far as i can see without being able to read the wording completely accuratly it appears completely kosher.

                          Were your husbands circumstances thus at the time that PPC would have been of use (ie he wasnt self employed or had similar cover elsewhere like you had?)

                            Yep, looks kosher too me too, unfortunately.

                            He's still in the same job, no particular special schemes for anything. But he has got (and has had forever) problems with his back which would have rendered it useless if he'd claimed. The PPI I mean. His back is useless anyway.

                            I have to say I think this one is a non-starter, so am going to give up on it now.

                            Will see how I get on against Crap One then claim his from them later, if it works.

                            Do you think Crap One will want proof of my "generous redundancy and sick pay scheme?"

                              8 out of 10 complaints to the FOS are being upheld precisely because of the situation you describe here - just keep going.
