    Okey Dokey

    I am going to claim PPI from my Black Horse secured loan.
    This was a policy where the lump payment was set at the beginning

    I am still reading up on this and will post up my letters as I go along

    Was the lump payment added to the loan at the start and interest paid on it throughout the period of the loan ?

        Here is my letter

        Black Horse Limited
        25 Gresham Street
        London
        EC2V 7HN

        Dear Sir or Madam,

        Re: Account number:

        I purchased the above policy from you in September 2004 but now believe that I was mis-sold this policy for the following reasons:

        This is due to the fact that I was not given the correct information when the policy was sold to me, as
        • your salesperson implied that taking out the policy would assist my credit application.
        • your salesperson did not tell me that the policy was optional.
        • having recently looked at the paperwork for my loan I have noticed that only I am fully covered by the policy and Mrs PKea is not covered at all, when I was led to believe that all parties were equally entitled to the insurance cover.
        Unless you can satisfactorily justify to me that the policy was fair and reasonable I am requesting a full refund of all premiums, and subsequent interest on these payments, that I have paid to date. As I believe I have been deprived of this money I also expect 8% statutory interest, the amount a court would award, to be added to each payment made.

        I look forward to a full and prompt response to this letter and for the matter to be concluded within eight weeks or I shall be contacting the Financial Ombudsman to investigate my complaint.

          We used points one and two within our PPI claim, it was dismissed.

          reasons.... we get 30 to cancel policy, any doubt what so ever you could of canceled.

          If they wont supply any recordings or evidence to show that they did or didn't mention it was optional, the DJ probably wont accept the claimants word.

          That is how our DJ saw events.

          Mind you, our PPI was taken out 5 years ago and judge decided on the balance of probabilities and no contemporaneous records exist and recollections are hazy.

          Just a couple of points you should be aware of before relying on them.

              • As the documents were sent to my home to sign, and not in your offices, the policy was already printed onto the documents that lead us to believe that it was an intergral part of the loan as there was option box to decline this.

As I believe I have been deprived of this money I also expect 8% statutory interest, the amount a court would award, to be added to each payment made.

                            I have also got a copy of a complaint upheld by the FOS which is basically identical to my situation.
                            Not sure whether to include in my 2nd letter to them, if i do then i can also use it with the FOS as well

                              it wont do any harm to include it. Although don't rely on one upheld decision.
                              As you know, all complaints (and I mean that in the loosest sense) are dealt with on their own merits.
