    Just an up-date re situation.

    Finally got something sent off to FOS asking for the decision to be reviewed (not holding much hope though) and I tried to contact the person handling my case but she was always busy or kept missing her calls.

    Anyway today I thought I would just drop her a quick e-mail. Well I got an automated reply to say she no longer works at the company and to re-send to customer contact address

    Is there a specific FOS ppi email address ? Otherwise will just give them a call tomorrow.

          Well just to provide an up-date, I have just spoken to FOS as per my letter and e-mails. They basically said that the Ombudsman's decision is final, even though I have requested my date to be deferred and for further points raised to be answered :tinysmile_cry_t:

          They also mentioned that if I reject the decision then it will not be legally binding with Capital One and the only choice would be that I would have to take it to court. They also suggested that I seek legal advice and provided the CAB telephone number. They are not even going to respond to my letter.

          Then I was asked about their service today and if I had any further questions, in which I proceeded to say that it would have have been courteous of FOS to at least acknowledge my letter and provide some sort of reply. They responded that I could address a letter of complaint to the manager about the service if I wasn't happy with the way FOS handled my case.

          Totally dejected at the moment and I cannot see me getting anywhere further with this one and yet again feel let down by FOS

              What I don't get is the inconsistency (and thousand others I am sure), how can a one complaint be upheld and another rejected where both cases / reasons were the same ????? They even had the liberty to use mine as a non-advised case study. I counted 6 different adjudicators for my case, and everytime I contacted them, it was being dealt with someone new. I tried to speak to the FOS contact person last week who sent my later a couple days beforehand and was told that she was no longer with the company ?

              I suppose they have to balance it out at the end of the day especially where Capital One are concerned as believe ppi success rate is low

                  No worries di and thank-you.

                  I have rejected FOS findings anyway, so I can leave it open until I decide what to do next. It will give me a bit of time to refresh and collate more ammo (as I'm still awaiting SAR to come back) and have been doing a bit of research.

                  Your info and help is always valuable and really appreciate your time in answering my questions and passing on advice. It's a shame because if I had known what I know now, I would have handled this slightly differently.

                  Nevermind, onwards and upwards as my late grandad use to say :tinysmile_twink_t2:

                    I have just received a rejection letter from Capital One dated 12 June and was intending to appeal the decision either by going back to the CEO for Capital One or to the FOS and was very disapppointed to read about this FOS decision to uphold the Capital One rejection.

                    My circumstances are almost identical to the one here namely I responded to a Capital One mailshot letter in 1999 and ticked the yes box on the " Short Application Form ". I had no need for PPI as I was a Government employee of 15 years at the time as stated on the form. I had sick pay cover for 12 months and a redundancy package. Capital One have used the non-advised reason for rejecting my complaint. I have another similar PPI complaint running with a Northern Rock credit card responded to by the Co-op Bank who took over Northern Rock credit cards.

                    I have received a Co-op Bank rejection letter, again using the non advised reason having ticked the PPI box on the application form in 2001. In both these cases I cancelled the PPI in February 2004 and September 2003 when I concluded that the PPI was of no benefit to me.. In the case of the Co-op rejection of my complaint I have appealed their decision by going back to basics with them in that the Bank did not conform to the requirements of the GISC code in place at that time to which they had agreed on a voluntary basis to apply to their dealings with their customers. I have not yet received a further response from the Co-op Bank.

                    It might be helpful to this case if I had some support and guidance in framing an appeal to the FOS with a view to having my appeal upheld

                      Hi and welcome

                      Do you think you could post up the letters you received please? (if you have the scanning facilities to do so) and also by deleting personal details etd?

                      Myself and others can see what we can do to help, but there is a way you can make an appeal to the FOS about the way they dealt with the complaint, the adjudicator who dealt with your case will provide you on requsest the details of how to first complain to their particular manager, so you need to ask for details of contact to the service manager, they can send you this by email, if this fails then its moved on to their assessor....

                        upload this information from my computer I am receiving an error message " Invalid File " can you advise please on what I am doing wrong. Thank you

                          Further to my earlier post today I would like to add some clarification to my original post insofar as I have not as yet appealed to the FOS about the Capital One rejection letter and would like some advice and assistance in framing a reply. First of all should I appeal to the Capital One CEO or go directly to the FOS. Thank you.

                            I will have a word with the admin about the attaching your info as I'm not techie minded lol.

                            We do suggest to try the CEO before going to the FOS by giving them about 14 days, you need to let the CEO know the details of your complaint and giving the chance for the complaints team to put right, but they have failed you, once we know the full details of the letter) we can work on a reply
