  • Ppi claims upset ?

    Hello everyone I'm a newbie here , I've been reading some of the excellent advice throughout this forum and I'm really impressed with everyone's welcoming and advice I'm interested if any one can help me in this situation I'm in ?
    I will start out by saying yes I'm a fool , a naive one at that!
    right back in 2009 unfortunately I was declared bankrupt a low point in my life but the only way out of the mess I was in
    a year passed and I was discharged everything seemed ok I set about getting on with life dealing in cash only all ok no problems
    then from time to time was contacted by ppi company's asking about my history etc I generally fobbed them off and was not interested at all , they kept pestering me and after time gave in
    to a company called red star financial management
    the process was fairly simple filled in forms etc the process took about 5 months I forgot about to be honest because of length of time but my creditor also wrote to me saying I was eligible for a claim but account was in arrears not stating how much ! I didn't have any paperwork with balances etc and I've moved property's about 3 times etc , red star hassled be to sign consent forms which I did , it all went through , but my creditor took all of the claim and offset it against what I owed ! Thus leaving me with nothing , ok fair one I thought that would be that , no the claims company wanted the fees owed I explained I did not receive anything but they said they have won this you need to pay !
    which opened my eyes to me being a fool
    I've looked into this and found out that even though I was discharged from bankruptcy any monies awarded should go the official receiver as forms part of my estate , if the official receiver
    had taken the money's the ppi company wouldn't see me for the bill , I've phoned them but they are not interested !!
    i feel misguided by this , also a fool as stated above
    do I have to pay the fees ? What will happen if I don't pay them ?
    i wouldn't of entered into any of this if I knew any of this please help somebody ?

    Hi and welcome

    Sorry to learn of your issues here and I hope someone will be along soon to advise your best action on this particular matter.

    The only suggestion I can make at the moment is to contact Minstry of Justice (MOJ) Claims management and put this forward to them (that's if you have not done so yet).

      Hi

      Did you inform Red Star Financial Management that you had gone bankrupt and the claims was being made against a debt that was included in the bankruptcy?

      How much approx. was your refund and how much are Red Star claiming from you?

      Do you have copies of terms and conditions and contract you signed with the CMC?

        Hi amethyst , thank you for your reply, I did verbally inform them
        but did not have anything written down to confirm it with the paper work they supplied me ? My fault for not being more aware of this but hindsight is a wonderful thing
        there fees are 25% of monies awarded , the monies awarded were £6025 approx

          So £1500 odd they are chasing you for?

          Do you recall how much was left on the debt the claim was against when you went bankrupt?

            Yes that's about right ,I can tell you now that there was £15000 approx on that account to which I went bankrupt for
            and the one I had the claim made for , but and this is the big but !
            i didn't know this at the time when I was foolishly signing paperwork getting me in to this mess , I thought that my debt had been written off it didn't exist
